Shaping Domestic Conscription

This is the stage my mind has been in for the last 24 hours and yes it is a DC comic reference. You see, the movie Thor, Love and Thunder woke something up in me. It was the mid 80’s and there was a Dutch version of an Avengers comic book I read. In this there was a reference on a ‘villian’ which led to all kinds of things and I remember that in the end there was an image of all in hell for torment felt relieved for a second as Lucifer felt fear for the very first time. It was about the optional undoing of Eternity. The end god in the Thor movie and he was just like the real thing, except for size (the length of his foot is about the size of the Chrysler building) but lets keep this to semantics and creative freedom. Yet these is the stage, it started my thinking. You see, it started at that time and the movie Black Adam merely build on the stage my mind devised.

I gre up being a huge Batman fan, in my preteens I grew up on the Batman that Adam West gave us and the man was dope. He was the real deal. OK, that is and will forever be the kid talking in me. But as others went for all the other comic book heroes for whatever reason they had and this tainted the thoughts I had. There was a side in that comic book that gave me pause to think, even now almost half a century later these thoughts are still there. What if the villains were right? They might go about it wrong, but what if there is truth in their actions? Joker, Lex Luthor, Ares, sorceress Circe, Lucifer, and that list goes on. So what happens when we create a hidden trap. A mindset where Batman does the ‘right’ thing, but he falters to see what he does is right. The encounter with someone like Eternity brings it to the surface? It allows for an interaction with Constantine, it allows for all kinds of options. And today’s world is all about what is legally right and what could be correct and they are not the same thing. We have all seen versions of that and as far as I can tell the comic movies aren’t digging into that, even though Black Adam gives a nice stage to exploring that side deeper. The creation of Amanda Waller allows for a deeper investigation of that side and perhaps the people behind DC movies should do just that. You see, there is too much polarisation in these movies and for the most we accept this as the villains in these movies are over the top bad. Yet what happens when the hero (unintentionally) overreacts? We see that in some cases, but at times it is some plot twist. What happens when we wrongly hunt down a person and we learn after we stop them that they were trying to set us all free? Consider that we have ben misled by the church for almost a millennium. Now consider that we have an Arabic setting where an Afreet is set free, but that Afreet is tinted by the history up to 1200AD, that character missed out on 800 years and that anger is now unleashed. We want to ‘protect’ and stop that character and we now have a setting that approximates what we are trying to achieve, because we learn of what was done is only now beginning to surface, in this we create a new level of ambiguity. One that most comics never touch on and it is these new borders where we get a much larger setting for who are the actual villains? Perhaps some are tainted through polarisation and recognising that opens a new dialogue, a new stage of more interesting movies.

Consider an article from 2019 ‘Medusa was punished for being raped—so why do we still depict her as a monster?’ This sets a new premise towards the stage of a Medusa. In the Theogony, by the 8th-century BC poet Hesiod, she is described as being the child of Phorcys and Ceto and she was raped in the temple of Athena by Poseidon and Athena punishes her of all people. So what happens when we see this in a new DC setting, but until the end of the movie we aren’t told of HOW the transgression started and that opens up new doors, opens up other doors too. What if the avenging demon is Lex Luthor, getting aid by Lucifer no less and the stage is that Constantine is trying to figure out what Lex Luthor is up to (and of course Superman gets involved). Yet as we are given a partial tapestry, the loom will see the involvement of others, but until that for example the daughter of Wonder Woman Trinity was kidnapped which starts the manhunt, but at the end we learn that Trinity feared her future and got Lex Luthor to aid in her escape her dark future. Lex feeing for her and feeling his heart for her aids her and it starts a much larger feud all fuelled by Lucifer (which gives us Constantine) and there we have the making of a larger tapestry and the loom involved has the wires in one direction and cannot vouch for the fabric of the tapestry (an Odysseus reference). The stage that still bothers me is how the loom is managed, someone is pulling the strings behind the curtains of the stage and that comes to light after we see parts of the truth involved. It creates new settings of polarisation, not entirely unlike the people choosing team bat (team Cullen) or team hound (Jacob Black). The same is said for the Underworld saga. When the people are left to chose which team is the right one, you get a lot more interaction, a lot more social contribution and that pushes the story and the movies to the top of so many lists. Ambiguity gives us one side, but not all sides. What happens when Ares (opponent of Wonder Woman) is pushed to this degree by the fates Clotho, Lachesis, and Atropos? What happens when they are pushed by the future and by someone wielding that side to push towards a reality free of Αion, the god of eternity? We now have a very different setting and we get the question into the open, what makes a hero a hero and a villain a villain?

Just a few thoughts going through my head (its Sunday after all) and tomorrow is another day.

Enjoy the end of the weekend, soon it will be Monday.

One more nugget

It started this morning. My mind was all over the place, it is the last day of the year, so it is allowed to wander (I am such an enabling person) and whilst it was wandering, it started to shape an idea. It is about making merchandise more functional. Now the first idea was for Bethesda, but they are Microsoft now, so they lose out.

It was their Bobblehead trophy display that got me thinking. You see, gamers love their merchandise and some is neat. Yet most of it, nearly all of it has no real function. Now, this is fine. Yet what happens when the bow of Aloy does get function. It has hidden spaces for memory cards, it optionally even has a USB dive. The outer part can be exchanged so that you could always get a bigger drive. It could also hold a power bank, and the same could be the case for the  spear. Now the fan has a functional device and there is no one who needs storage and a power bank more than a gamer?

The combinations are endless. And it does not matter where you play. The HALO helmet, the spear from Aloy, the axe from Kratos, all devices that are cherished and will be cherished a lot more when it comes with something functional. I was happy when I got my pip boy with Fallout 4 and it was a great start, but consider some of the other games. Minecraft, Pokemon, Mario Kart and the list goes on and it is not merely me. Talk to any given fam and he (or she) will come with the line “Do you know what would be cool?” And some of them will be truly cool. And it is not limited to simple devices. Some limited items no longer function, but that is not a given. The chainsaw I had with the gamecube edition of Resident Evil. What if there was a power bank with Bluetooth that could connect and make it work on a remaster or a new console? The device is generic, but could be more. To see this, in one time I had a N7 vault for my Xbox360. Now, this doesn’t hold up nowadays, the Xbox dimensions changed, but what if the vault was empty but connected? The same for the Master Sergeant helmet. What if they have additional options. The fans will go nuts and they will be happy for a very long time. Now I gave a few shallow examples and they are not the ‘real’ deal, but they could lead to the real deal. In a previous article I mentioned two items that when inserted into a ‘real’ wizarding wand could become a controller. The two elements are generic, so they can be moved from ‘toy’ to limited collectors item. Some stuff is playful, but from the playful to the shear appealing items for many gamers is sea of choices. And the merchandise makers have been about the short term appeal and left it there, but the stage could be a lot larger. The connected items could become a lot more. Who has not seen the Diamond Minecraft sword in toy and game stores? So what happens when we connect one element to it and suddenly your diamond sword becomes +2 stronger and lasts 20% longer? The location devices could be used. A larger stage for more use and making the game enticing, the gamer happy and all matters of options in-between. The bow of Aloy was merely the key to open a much larger door, the merchandise door has been largely ignored on many levels and why? Even now, today as I saw some of these items in shops. I see the larger stage ignored, the missed stage of interaction. Now, I will be the first one to admit that this is not always possible, but what about the Mario Kart that is also a night light? Basically a battery, lights and wires were missing, three parts and suddenly people pay $10-$20 more and some eagerly so.  The larger part is not that people pay that amount extra, it comes with the stage that thousands (if not hundreds of thousands) of gamers will get it as well because it was cool and the last three games sold well over 120 million items, so how many would want a kart that is a USB charged night light, optionally more? A whole niche with gaming connections spanning EVERY console out there and nothing to connect it at present, or at least massively too little of it. I remember my first figurine. A ninja, it held a sword which doubled as a letter opener (and that thing was bloody sharp) now consider the Assassins Creed figurines, or the Witcher or bloodborne figurines?

The Ninja was 1980 something, now we get the person who wants bloodborne and if that knife is also a letter opener, so much the better. And the nice part is not that it is everywhere. It is the figurine and optionally the collector can buy the knife as well. We need not have it everywhere, but some will want it. The market is flexible and no one is looking into this direction, or perhaps they are rejecting it. So what about the Sonic batarang? I was playing Arkham again last night. Why not have that batarang. As an actual bluetooth device, or even have the bluetooth as an optional expansion, we can look in so many directions and too many aren’t doing that. Now, lets be clear, these are not all great ideas, but they open a train of thought and that thought is ‘What else could we have?’ I had return to Arkham on day one and it came with a batarang, it looked nice, but was a bit of a let down. But it could have been so much more. So why wasn’t it? Some f the game developers have created the coolest games and the coolest items in game and they racked hundreds of millions of fans. So these are already in your corner, why not see what more you can do to make their gaming experience so much cooler? It was not that big a leap and they aren’t making it, why not? What stopped them? And another matter, not all items can contribute in the game, but like the bow with the storage and power bank, its use goes a lot wider than the game and it could contribute for a long time, optionally for years to come. It is the kind of marketing a maker hopes for and almost never gets. I wonder why.

The Kay Pea equation

There is a setting I have skated on a few times. This is not the first time I raise it, but I feel strongly about certain options. A first was a puzzle I enjoyed. It came with a book. The story was a murder mystery, but there was no solution in the book. The added part was a jigsaw, the image would reveal the actual culprit. I had 6-8 of them and they were fun. But it was something someone (I do not remember who) made on the Commodore 64. They were Kinetic Puzzles. To explain that is simple. A jigsaw is the puzzle made from an image or photograph, I still enjoy jigsaws with some regularity. A Kinetic puzzle is not based on an image, but on a film clip, hence every puzzle piece is always showing you part of the clip and it makes for a somewhat ore challenging puzzle. The weird part is that this should have been on the eyelids of Netflix from the start. Movies are their bread and butter, what better that a puzzle that represents a clip from an upcoming movie? The solution tends to be the same, edges first, then you work your way in and when the image on EVERY piece is in motion, the challenge is soon felt and endured. Marketing through a game, it would be the cornerstone of Netflix and even as the puzzle part is not the hardest part, putting this all in a puzzle is still a challenge. But they did it on a Commodore 64 with a mere 38Kb of RAM. As such evolving towards 4K puzzles is not a leap of technology. And this came to my mind again as I was crossing the ‘i’ and dotting the ’t’ in the equation that is coming. Inversion is in part the name of any game and it helps when you are your own devils advocate. So when they consider this and add the simple Jigsaw part, Netflix will have a whole score of puzzles and the fans of movies will enjoy a game that reflects their passions. Streamers had this option from day one and some did not go in this direction for all kinds of reasons, but were some of the valid? They might think so and I am not debating that part, but what about the audience you are addressing? Did you think of them? Are they not your consumer core?

Did you think that a Netflix customer might not like a puzzle regarding the Batman (who looks a lot like some famous Hufflepuff student), or any league of other heroes or villains? I wonder what these bosses were thinking when they pushed people out stating they needed super cool games, was a better question not ‘A game that could appeal to our core clients’ The KP or Jigsaw will not do it alone, but people will always return to something they enjoy, especially when they are fighting the hours, at that point they will revert so something simple like Chess, Checkers or Puzzles. And with an additional mode that is not seen anywhere, this might be an Initial solution all might fancy. Perhaps the idea of adding books to the jigsaw equation should have been on Amazon’s mind. There is not a soul who does not know what a Jigsaw is (aka puzzle) and they go back to 1760, a very long time before the house of Pong made its entry. Did anyone even consider to cater to puzzles to create awareness? Netflix has been in a prime position for the longest time and they never acted on it. They have the largest arsenal and they left it untouched, weird, is it not?

First the weird

Yes, it was something that happened on Wednesday night. It was (apparently) important and it involved Batman. It was a dream, mot likely about IP, but I cannot state whether it is based on the comic books, I do not think it was the Arkham games series. I also do not think it was the movies, but beyond that it is blank, I just cannot remember it and if I do not write it down quickly, it becomes lost. So now I have to wait for the REM stage to kick in again. Beyond all that, there is new IP. A new setting, a digital setting that comes to mind on some of the MB games, in the first it is Hotel and now we have a new stage, Yes, we can ‘just’ copy the board game, but that is such a waste of time, unless it is a mode you can unlock. A board that becomes bigger as more players come to it. The nearly same setting, but now we add a library of hotels. So the original game had the Boomerang, Fujiyama, Royal, Le Grand, Safari, Taj Mahal, Waikiki, and the President. But the fun part is that digitally we can add, we can replace keeping the game new and fresh. So we can get hotels based on famous hotels in Dubai, Las Vegas, New York, Los Angeles, London and so many other places. As we add multiplayer options where the player can select from a pool of online players, friends and game fans, this game could get a lot more attention, and history has shown that there was an interest in this game. I still haven’t given up on the notion of collectible keys (used on the Amazon Luna) to unlock elements in games that other games provide for. And Hotel could be no different. Other games unlock additional hotels and this game could unlock other elements in other games. A stage that pushes novelty and pushes the desire to play, to find and to embrace any game that streaming offers.

I mentioned the keys before and it could be one of several enhancements that could push the Amazon Luna (beside the 50M extra consoles option). You see, the need for gaming is different on streamers, yes there is a like minded setting with other consoles, but the plus value is not merely some subscription, it is the part where the subscription leads to additional sides, it keeps the gamer invigorated. And in sandbox games there is plenty to see, but in other games after you played it once or twice you think you have seen it all, unless you add to the game, unless the game keeps on developing. There is only so many times the bulk will play Monopoly. Yet if we can localise Monopoly and unlock local editions the interest in such a game evolves from medium term to long term enjoyment. And there several MB games could find themselves in a larger stage. In earlier writings I evolved the game Stratego to a much larger online stage. Yet what happens when we do this to the game Tank Battle? What happens when we evolve the game Clue to a version based on the CCG the X files? All games with multiple options, all games with an evolved nature that offers long term appeal. And as stated on multiple times, some of the original CBM-64 games could get a whole new era of gaming enthusiasts if they put their mind to it.

All settings that some ignored, some were forgotten and many were overlooked, or perhaps the game designers never considered the early years of gaming. Just like some of us seemingly forgot  about some of the TV shows from the 60’s and 70’s, several of them bubbling with new life if the right director comes along. The acquired IP from the old days could be the cheapest and that offers a whole new stage. Some of the makers are all about looking at the new, but to find. Truly new series with no connections to the past is so utterly rare that it is almost folly to join those crusaders, all chasing windmills. Which is still weird because the fields are covered with fix them uppers and some of them have solid housing frames.

The fact that some are racing to remaster decent PS4 games for PS5, and they are merely looking behind them, in the rear distance there are true gems waiting to be rediscovered and I hope Amazon does so, Google too, but then they decided not to develop games, so they need to rely on the indie developers and some will be looking towards the CBM-64, Atari ST and Amiga games. As I see some development notes pass by, I can see that they are and they will have decent chances to pick up an interesting amount of coins.

It’s IP but not mine

I just had the weirdest daydream. In the dream I was playing a game I had never seen before. I think it was a mini-game. It was set to either DC or Batman, I honestly cannot tell. What was the setting is that the mini game had two sides and you play one side. It was like a puzzle, the weird part is that you decide to either play the antagonist, which was based on Christian Bale as the Mad Hatter with ginger moustache and goatee and the stronger he becomes in the mini game, the better your upgrades get in the real game. The mini game is time based, so you get time to consider moves and the time is set to the maximum amount of moves and time to think is reduced. So as you ponder moves you might end up only having 3 moves (in stead of 4). The opposition was the assisting protagonist played by Ewan McGregor as Bobcat. If he gets stronger he gets more upgrades and the main character gets less. It is an odd thee sided equation. The weird part is that time is a larger element in the game. I was playing the game and I was selecting moves. The board looked very “steampunk Jugendstil’ if I had to coin a phrase. I had never seen the setting before, but it was not the mini game that was capturing me, it was the tactical side of the mini game. We always tend to go to make OURSELVES stronger, to set another level by making the opponent stronger is something I had never contemplated before. We could make our assisting protagonist stronger but that also comes at a price. It is almost the equation of 10 points can be divided. If the opponent ends up with 4 points, the 6 points go to you you think, but that would be wrong, Bobcat gets 6 and you get 4, so it is a different kettle of fish. You need to make the opposition stronger to gain strength, so if Mad hatter gets 6, 6 points open up in the main game and Bobcat only gets 4. It is a different kind of seesaw. The issue in the game becomes if Bobcat becomes too strong, Mad hatter ends up being weaker, but then so do you. A puzzle where you need to consider that your allies need strength, but you need to enable a little more for you. Because if one gets too strong, the third party (either you or bobcat) loses out too fast and when the game essentially requires two players, you are out of the game, because Bobcat ended up out of the game. It is a very different dynamic and that dynamic requires a level of balance. You see the (so called) AI in a game can be twisted to break on your behalf, but if YOU become the measurement of balance and opposing decisions the decision making tree becomes a whole new thing. To coin a phrase; “The game Skyrim has skills, so if you become stealth level 5: You are 40% harder to detect when sneaking”, so what happens when your stealth level 5 implies that some opponents automatically become level 4? You have all these kinds of opponents in the DC universe. So we have the armies of the clown, two face and the penguin. They have soldiers, sergeants, lieutenants, and captains. So what happens that in stealth the captains automatically become level 4? In fighting, if you are level 4, officers are automatically level 3 and below are level 2. But it is on top of what they naturally have, so you need an altering game, you cannot become a one trick pony. And the mini games decide on your assistant in that part of the game Bobcat, Catwoman, Bluebird and Azrael. It changes the dynamic of the game and more importantly is creates a much larger replayability and more challenges. Because you were playing part of a 3 sided dice and that changes the odds and the options throughout the game.

1,2,3 sided dice

As I stated this is not my IP, if any it belongs to Bob Kane, as such I put my thoughts here as Public domain so that (optionally) Mr. Kane can still become aware of it.

As far as I can tell, this has never been done before and as such it might be an interesting push for a more challenging form of tactical games. Well, that is my part played, and it is time for me to have a sandwich and contemplate a few things in the Middle East. I think it is time to check what the media was so eager not to tell, especially as some players do no longer have the means to do the things some claim THEM to do but that is life. Have fun and Auf Weinerschitzel.

Before life was, I was

Yup, there is the ego, floating over your head, look to the right, no, your other right, look about 43.8 degree higher (if you are outside) take the second star to the right, yup, there I am. So as you might have guessed, it is time to talk about god-games and whatever I consider here, is free to use in any Sony exclusive game.

To see this, we need to go back to the foundation of god-games. My introduction to this type was in the 80’s when Little Computer People came to the CBM64. We all see the age of Peter Molyneux as the stage of the ‘true’ god games, but it is out in the open to accept or reject that notion. And in all this, most of us might remember the game Black and White. It was a more god game than most god games and even the guy upstairs agrees, right Hades?

Yet what if we create a game where it is merely part of the game, not the game itself. For example, if we set to an example most of us remember ‘Assassins Creed Brotherhood’, consider that the game remains the control of Ezio Auditore, yet the god side of it is that we can to some degree control the actions of NPC’s. An example, Ezio is running through town, and that is fine, but in the god side we unleash rain on the area and as a result all the courtesans hide inside their houses. Ezio loses an ability to his side. This is a crude version.

So if we use the divine powers in Black and White, it is a direct option, what if it becomes indirect? Like drawing a line in the sand, the ants will find another path, but that is as clear an option as it comes. So what happens when the game is about indirect channelling and it becomes about indirect guidance. Not as a setting in the game, but as a setting towards the game? So like Batman fights his opponents in Arkham knight, we influence the brutality of those around him, we set the premise of depression of the victims around him, it changes the game, it changes his focus, whilst the gamer does not see a change in the player, the stage we see in detective mode of Batman and we see the criminals are at some point terrified, Batman instilled this, but what happens when we set a secondary stage that affects the persons in the area, but Batman cannot directly influence that. That stage is influenced by the the NPC’s, not like the stupid wave like behaviour we saw in AC Unity again and again, but a sort of herd like behaviour in NPC’s, it changes the entire setting of the playable area and we forgot about that, thee gamer (and the developer was so focussed on Ezio Auditore, Batman, Edward Kenway, they forgot to set the influence stage on the population when Batman, Poison Ivy, or Vaas comes into the level. Yes, there was some attempt (AC Unity) the the fear was where we see street run away in front of you was a failed attempt at this. A stage where we can only influence a second tier (up to a point), is something we have never faced. In this I grab back to the Black and White part. Until we set the premise where an evangelist is created by their own choice, the influence is limited. So we can directly interfere in the game (buildings, infrastructure), yet the NPC influence is only limited. Games like Spore, Black and White set the action as direct. I want to change that, give a much larger challenge where the person having the finger needs to think where he draws the line for the ants.

It is a speculative setting, but that is all that I can offer in a conceptual setting. It is conceptual, because it has never been done before and evolution of games happens in a stage where things are new and never done before, there was always the first one. And that is what we are aiming for, something never done in gaming before, upgrading the level of gameplay down the line, and that was all that gamers want, a new level of play, we all want that, because sooner rather than later more of the same becomes tiring. And for the most, the sandbox games has left the NPC part of their game to too much of a limiting factor. So we need to change that side of things if only to make sandbox games more realistic and more believable.

Creativity overboard

Yesterday was about the heralding of creativity, yet there is a setting where creativity goes overboad and the Washington Post gives us ‘Scarlett Johansson on fake AI-generated sex videos: ‘Nothing can stop someone from cutting and pasting my image’‘ (at https://www.washingtonpost.com/technology/2018/12/31/scarlett-johansson-fake-ai-generated-sex-videos-nothing-can-stop-someone-cutting-pasting-my-image).

It is a lot worse than you think and even some might trivialise it by merely hanging onto the idea of women, mostly celebrities being inserted into porn, the problem is actually huge, not merely because of that application. The issue is that whatever I can creatively dream up, I can make a reality if I have enough images. The problem is that most of this software is free (for now), and the problem is growing on two fields.

In the first field we see not merely exploitation of any woman into porn, nudities or weird situations. The technology is close to perfect enough that it is harder and harder to distinguish the fake from the real, the deep fake is overwhelmingly convincing that the Washington Post comment “what your eyes can see and your ears can hear can no longer be taken for granted in the digital field“, that problem is a lot bigger than you think. Even as this example (at https://www.youtube.com/watch?v=BU9YAHigNx8) is easy enough to spot, the overall quality is very much on the high side. Here money gives authenticity, the better the computer, the smoother the result and the shorter the timespan to make that result. The average laptop will not get you far, yet a high end gaming PC gets you an optional 1080 HD deepfake version that is increasingly hard to distinguish from the real deal.

In the second field we see a failing, a failing to investigate and legalise the optional prosecution of deepfake video. Not merely the porn side of it, in its heart the opportunity to crate identity fraud and give rise to interfering with political, social and private lives will go further and will be the foundation of a lot more hardship. 5G will merely send these high end videos faster and wider on a global domain. How long until we get the videos of random politician (Emmanuel Macron) and random Celebrity (Anna Kendrick), whilst places like the Daily Mirror will give the innuendo “European Politician accused of hot Hollywood encounter” with a deep fake? The issue is not that a place like the Daily Mirror would or would not use that image intentionally maliciously, the issue will soon be that their trained professionals can no longer tell the difference between real and deepfake and there is more than one indicator that that moment could optionally be reached this year.

The third part is that not only is this technological field charging ahead, the legal field that should protect the people can no longer keep up, in addition the freedom of expression that allows for ‘creative alteration’ is actually assisting in what should be regarded as criminal activities. In addition there is a larger failing in the law, McMillan (at https://mcmillan.ca/What-Can-The-Law-Do-About-Deepfake). The working allows for a failing that no one is able to deal with. We see this in: “The tort of appropriation of personality arises where a person attempts to gain an economic advantage by using some aspect of another person’s name, likeness, or personality without that person’s consent. To be successful, the plaintiff must establish that the defendant appropriated his or her persona for economic gain. This is also enshrined in legislation such as the BC Privacy Act, which states that it is a tort to use a likeness, still or moving, including a likeness deliberately disguised to resemble a person “for the purpose of advertising or promoting the sale of, or other trading in, property or services.”” You see, the failing is not seen in what must be established, it is found in what is negated. We think of lone wolves as terrorists, yet there is another one, the political lone wolf. A person not recognised by anyone, but does the bidding to promote the political field (or alternative field like product field) of others.

When that person goes after the next political contender we see no ‘gain an economic advantage‘, we alternatively see no ‘trading in, property or services‘, yet the damage will have been achieved. Even when we look in the US regarding: “Malice in law is the intent, without justification excuse or reason, to commit a wrongful act that will result in harm to another. Malice means the wrongful intention and includes all types of intent that law deems to be wrongful“, to enter in court on the premise of malice and intent versus ‘creativity and freedom of expression‘ becomes a first amendment court case where the political player loses no matter what and if the transgressor is young enough the damages will never ever cover the impact. In this day and age of viral video and social media, one or two of these videos could end any political career within a day and that is merely the top of the iceberg. Larger players can lay waste to all kinds of opposition with a much greater ease by giving rise to confusion and relying on the gullible population to spread the damage.

McMillan gives one part that could give the smallest of coverage in British Columbia. As we are introduced to: “The BCHRT has the authority to provide a compensation order for any lost wages or expenses incurred as a result of the contravention, and to provide a compensation award for “injury to dignity, feelings and self-respect.”“, how could any unemployed individual compensate for damages inflicted? The problem would not be the act, the issue would be to a much larger degree the setting of ‘injury to dignity, feelings and self-respect‘ when it is a public figure, especially when we consider the last 10 years where: ‘less than 20% of the orders made are over $10,000‘, in a setting where so far $75,000 has been the highest award. So tell me, who would not fork over $75,000 in some way to win a high end election? Even as the Canadian system is seemingly a little better than most out there, what they have is nowhere near ready to deal with the larger impact the deepfakes optionally have and that is merely outside of the porn application field. The experts that gathered in the SIGGRAPH 2018 annual conference on computer graphics in Vancouver from August 12th to 16th 2018 already agree that this is going to be an issue in the 2020 US elections, the question is will the law be ready and there is no clear indications that it is.

Even as we see that DARPA has been taking an active interest in finding forensic solutions, the department by Dr. Matt Turek, I also see the flawed impact as we see the optional miss that a high resolution result projected deepfake, then captured by a low res camera will create a version that is either negated completely of will be flagged amongst hundreds of thousands of others and still ends up having a 60/40 chance of passing through. Those numbers are not encouraging and this forensic field is for now in its early infancy giving the deepfake players close of half a decade of free reign on every social media with 5G merely impacting a much larger population, much faster. The overwhelming part is that computing power and high resolution recording equipment is becoming more and more affordable so the pool of non-malicious offender is growing close to exponentially for now. Let’s face it which horny teenager has not dreamt of replacing his prom date with the image of Amber Heard, Bailey Noble or Laura Vandervoort as his desired prom date?

It is for the most the absence of intent and malice that is driving the technology. America has 42 million teenagers, close to 22 million are male, most dreaming of the dream date they can never have, so when there is a software company keying in on close to 50% of those offering a $49.95 solution making their dream come true, that is a market surpassing $1 billion, do you think that this is not happening right now? It is a massive driving force, apart from the sex sells part; it is within us to be a pranker/prankster, to replace ourselves with an edited Batman/Batgirl making ourselves the superhero, others want to be seen with their idols (Frances McDermott/Zack Effron or Bailey Noble/Heidi Klum) depending on our age and spreading that imagined tale on Facebook. At heart it is deceiving (read: pranking) their friends intentionally yet completely absent of malice and for every 50 people that do it for the innocent reason, there will be 1-2 malicious people, yet the overwhelming drive for that software is there and the more that want it, the cheaper the solution and for now that this trial software is often free and it is becoming highly perfect in the result, after which it will soon be sold at an affordable price. The problem is that anything innocent can be perverted and the deepfake technology that made yours truly look like Batman (actually Batman was real, Bruce Wayne looks a lot more like me and a lot less like Ben Affleck) can do the same for any exploiter to look the political target look like an arrested person on the street, two of these viral events can totally impact the next elections. Even as the politician itself is the likely target, making the members of his team (like the spokesperson, the strategist and the writer) targets would be a lot more effective, we will dismiss the political person often out of hand, the people they work with less so, it will create doubt and stop their political engine overnight giving the election away to the other person and with the deepfake field evolving at the speed it does, every political party will need a high end reputation management firm in their corner watching out for these attacks and in addition spend too many resources dealing with these attacks, making the small players no longer a consideration and making the larger players spend a whole chunk of money in different areas impacting their visibility. The lack of law, or more correctly stated the lack of impact that the law currently has, will drag elections and public profiles along in very different directions soon enough.

That part is seen (at https://www.ubermetrics-technologies.com/blog/reputation-management-what-to-do-about-deepfakes/) where we see how Jordan Peele is doing the speech for former President Obama and more important, the fact that this looks authentic enough to fool most republicans into an emotional frenzy, game over and the next democratic president starts in 2020, that is the game now and it is frighteningly indistinguishable from the real deal. Even as we see here the stage of ethics, the issue is not merely consent (it only partially is), we see: “the person whose face is superimposed on deepfakes did not give their consent“, in the batman example, my image is the one superimposed and I am giving permission, it is the other part that is owned by DC Comics, or is that Zack Snyder, or perhaps Ben Affleck. Do you think that their engine is ready for millions of trivial cases, often limited to a ‘cease and desist’ order? Their workforce would not be able to deal with 1% of that workload and in the initial race that viral propulsion was optionally used to their advantage. The issue is more loaded than we think and when the court case comes and I would state in my defence: ‘I was merely expressing myself, fantasising on being the next Batman. I made no commercial gain, merely social visibility for my desired optional career in acting‘, do you think that I will get anything more than an optional slap on the wrist as I was pursuing my dream? With the right lawyer it could optionally be thrown out of court as there would be no visible harm or hardship to Ben Affleck, the case ends soon thereafter.

Even as law firms give us the stage of: “must typically prove that the defendant—the person who uploaded the deepfake, for example—published something that gives a false or misleading impression of the plaintiff in such a way to damage the plaintiff’s reputation or cause them great offense, in such a way that would be highly offensive to a reasonable person“, now consider Hustler Magazine, Inc. v. Falwell, 485 U.S. 46 (1988), there we learn that the first and fourteenth amendment is prohibiting public figures from recovering damages for the tort of intentional infliction of emotional distress (IIED), if the emotional distress was caused by a caricature, parody, or satire of the public figure that a reasonable person would not have interpreted as factual. In that setting the deepfake field is wide open to be used against political figured to a much larger extent, that case was never ready for deepfake and by setting the stage to ‘a caricature, parody, or satire of the public figure‘ we see that the reasonable person becomes malleable to the greater extent making the deepfake field a much more effective political swaying tool than we imagined. I reckon that under this setting Larry Flynt will be laughing on the public stage that his case opened up for till the day he dies.
