The Game of Patent Law

I am in a very weird place. I must admit that I have not been in the brightest of spots. I am struggling with this semester’s subject. Even now, I am still studying too. I stopped writing on notes and going over lectures because I needed a small break and because my mind has been telling me stuff I did not even realise.

You see, this all started on two parts. The first was ‘Person Skilled in the Art’. I looked at it from many sides, but I forgot, no, lets state, I did not completely comprehend the legal part in all this. You see, Wiki tells us ‘If it would have been obvious for this fictional person to come up with the invention while starting from the prior art, then the particular invention is considered not patentable’, which might not be the most academic view, but when we consider the more ‘academic’ part we get “In these fields the persons skilled in the art are not just skilled artisans. They are often trained engineers and scientists, who are well versed in the periodical literature of their subjects“. This we get from the case Sunbeam Corporation v. Morphy-Richards (Australia) Pty Ltd [1961] HCA 39; (1961) 35 ALJR 212. Here Justice Windeyer referred to this in [218] “scientific inventions, intricate mechanical arrangements, chemical processes, electrical and electronic devices and so forth

You see, part of this is my issue (truly an issue I have). It comes in two parts. The first one is a memory from my early secondary education. We once had a discussion on Art versus conceptual art. It never made sense to me because I regarded both pieces as art. In some view we see that conceptual art focusses on the involved idea in the work takes precedence over traditional forms and material concerns. But is that true for some? Art is art no matter how you slice it. This has been in the back of my mind for a few days. At work in the last week I would listen to the soundtrack of Mass Effect whilst working on parts I was working on. I thought I was just trying to listen to music. No! My mind was kicking into high gear trying to make me see something and after this weekend, after 16 hours of re-listening to lectures and retrying to do what I could not do before, at roughly 10:18 it hit me! It was all connected, I suddenly got the gist in a scary way (because I get a first glimpse on how to solve it).

I need to get back to that ‘skilled person‘ because that is actually at the centre and it all links back to mass effect. In my view Mass Effect is one of the most brilliant pieces of work, possibly ever! The story is captivating, the graphics are amazing and the entire project is out there and I mean out there on the far horizon. Most gaming (me inclusive) always seek to look to the next challenge, the next big game. We almost forget the great games that got us here. Yet, Mass Effect always remains. My Google+ profile still has the launch party photo. In all this, the game was a breed apart.

So, how does this relate to the law?

This is part of the issue I have, especially with Justice Windeyer stating “In these fields the persons skilled in the art are not just skilled artisans. They are often trained engineers“. This has been my issue for a long time. You see almost two years ago, I wrote the concept for Elder Scrolls 6 (Restoration) and send it to Bethesda for their consideration. Not just more or an addition, no an entire new approach. In that same way I have bene able to reengineer in my mind every game I ever played. Now I am not a programmer, so making it is another issue, but my mind can see the game. Improve upon it, mould it into more, within my mind. The ability to see past the game, into the engine, the design and the story has been forever with me. Which was also the part that is stopping me. It is in essence the issue I have had with Ubisoft and Yves Guillemot regarding the dwindling of the Assassins Creed franchise. That is not even addressing the issues (read glitches and bugs) AC Unity and Far Cry 4 has been subjected to. AC Syndicate is now less than 4 weeks away and its predecessor have given a massive blow to the franchise. I saw some of these issues for a long time. Many things have been in there for 5 generations of the Creed, so if I can spot them, why can they not do so (or fix them before release for that matter)?

You see, here we get the PSA, here I get the block that Justice Windeyer (et al) bestowed upon me.

This is exactly where my problem is and yes, it is just me. I am not blaming anyone else. I never truly understood ‘Person Skilled in the art‘ (yes, it took me a while to figure that out), which means the rest became up for grabs. Yes, I comprehend the definition and I understand the premise, but when you can reengineer whatever you see, you (in this case me) tend to miss the point.

Now, in that continuation, how can one dissect “a pair of spaced apart slots in the first end portion each slot extending from an edge of the first end portion to half way across the first end portion; the slots being parallel to each other so that they and their projections define a pair of parallel axes extending across the first end portion, along the sides of the stem and across the second end portion” In case you were wondering, this is part of the description for an applied sheet of metal (I never knew my mind could project so many question marks).

Here I see myself like in Abbott Laboratories v Corbridge Group Pty Ltd (No 2) [2001] FCA 810. At [56] we see “I regard Professor Guilbault as quite unlike any person in Australia for the purposes of this case.  He is, and was at the priority date, a real expert in the field. What may have been obvious to him gives no indication as to what would be obvious to the ordinary skilled but non-inventive worker, even leaving aside geographical considerations“. You see, my ego rejects that part, because I am not a professor, I never considered myself to be ‘unlike any person‘, yes I consider myself to be an expert when it comes to games, but not to the extent the case made Professor Guilbault to be in his field, which gave me the issue of not grasping the level of the skilled person.

I am catching on (even though some parts are still really hard), but I have the rest of the day and 5 evenings to catch up with what I was not grasping. I am getting there though!

It still is an issue on how to set certain things, which is why my timeline differs. All this now shifts back to the games. I spoke about Mass Effect. The first game had an issue with the drive, but when we consider the first 360 systems (some people relied on a console without a hard drive, go figure). They got to play the game. The game was also one of the first to be decently open world, so that means that certain trigger points needed to be created. Which is what we saw in Fable 2 and 3. When you realise this, you can work around them. They are of course games and not real life, so the point shifts. Yet, in all that Mass Effect had an issue with achievements it never really fixed. I ignored it (but was a little miffed to miss out on achievements I should have gotten). Mass Effect (apart from the glitches) made a game truly replayable, which makes for more joy, yet unlike Fable 2 it did not create cosmetic alternatives. In all that, who (without cheating or hint guides) knew you could get to see Tali? Mass Effect 2 went even further in all this even as the game is still mostly the same, you can replay in another role giving power to replayability. Mass Effect is one of the only series ever to pull it off to this extent. So, yes, Mass Effect had issues (and glitches), yet the overall issue people had was with the ending. I less so when you realise the story in its totality, but the last one was a little sloppy in places. I saw through all that. So am I a nagger, a person skilled in the art, or am I beyond that? I have been around since before the VIC-20, so I know my games. In all that Mass Effect 3 amazed by offering the best multi player environment I have ever participated in (still not surpassed today).

Here is the kicker where does that leave the other game designers? In the mind of many we see that good gaming might start with replication, but the visionary evolves that into innovation and offer something totally new, something we all desire to play. I think the game Evolve is almost there. It is close to what Mass Effect 3 was, which is also dependent on a great AI and even though the levels in Evolve are bigger, you are still basically in a ‘cage’ with the big nasty. In all this Ubisoft is not sitting still. Although no personal evidence at present, as far as I can tell, from what I saw their new upcoming title ‘For Honor‘ is showing to innovate multi player from what was into what others desire. This is a very good thing! Jason VandenBerghe seems to have figured out what the big players were either not comprehending, or basically were ignoring. Now I am not one for hack and slash, I am not one for melee games, but I can stare in awe at the achievement of innovative gaming. This is what we will get in 2016. Perhaps Sean Murray (No Man’s Sky) wakes up one morning and realises that keeping people in the dark is only short term acceptable, but that is a lesson he must consider by himself.

Back to the innovators. One of the considerations with a person skilled in the art is: ‘A PSA would be likely to access and search IP Australia’s patent and design databases or get someone qualified to do it for them before releasing a new design of a ladder into the marketplace even though the level of technology is relatively low‘, this could be shaped into ‘A PSA would be likely to access and search IP Australia’s patent and design databases before releasing a reengineered design of a ladder, sufficiently distinct from the original into the marketplace as an innovative patent regardless of the level of technology required‘. In my mind I wonder how much power those with the ability to reengineer can hold, those who can see and value the originals for what they are. It is a legal trap to some extent, because the patent has protection under ‘they are more similar than dissimilar’, the registrar will take that into consideration and when it does go to court it will be an issue to argue, which is why I foresaw the evolution of mobiles, not in hardware, but a mobile generic base that is not unlike a stem cell approach, the software will shape the actual device and now we have two issues. Many nations are not have or reject more often software patents. Some state “The rapid decline in software patents is a huge boon for innovation“, yet in hindsight, there is another issue. Yes, I am all for innovation and bring it on, but not unlike Assassins Creed Unity it becomes more about the now and more about the quick sale and not about the quality of aftercare. As we move from a quality product to a short term choice, how do we fare? Is your budget ready for the annual purchase of a mobile? This is linked to all this, it is not just the Person Skilled in the Art, or the Person Skilled into the reinvented art. As we move from art to conceptual art, we also move from the finality of a choice to the transient of what might not become (again that assassins game comes to mind). All these elements move us in a direction that I regard as dangerous, we move from creators to innovators. Which was always intended to be a move that evolves into true new creators. No, now we move from creators to cheap solutions, something patents were never supposed to do, the person skilled in the art is the push we did not tailor to. I am evidence of that. I could never keep up with Richard Garriot or Peter Molyneux. Even when we spoke I saw their minds moving on to really new things, not iterations of the ‘what is now’. That is what corporate greed got us. A move away from the future. Even if we consider the computer as hardware, the timeline from the 8088 to the I7 now. The processors are no longer truly new, just slightly faster. A market controlled desperate to hold on what they have and not to lose it. That is not how the 80286 came to fruition, in that Mass Effect from game 1 trough game 2 to game 3 made jumps, not mere steps. You only have to replay the first one and the second one to see the leap we got. Assassins Creed showed the same in the original and 2, what came after became steps towards iterative work, iterative work is not innovative, which is why the small indie developers must be protected, if we are to move forward we have to protect true futures instead of orchestrated options.

Here I am still deliberating Person Skilled in the art where Lord Diplock states ‘a patent specification is a unilateral statement by the patentee, in words of his own choosing, addressed to those likely to have a practical interest in the subject matter of his invention‘ and the subsequent resolution by Lord Justice of Appeal Waller ‘a man concerned with the construction of a steel lintel to whom the use of the word ‘vertical’ would indicate precision‘. Here I find the issue with both parts, the second might be overruling the first, but the protection, or at least the approach from a malicious side gives pause to vertical could imply accepted to be ‘cheaper’, for if the engine is not tuned to be finer, it will be constructed to be cheaper, life has shown us that in the iterative part, which is part of the mess we now face. In my view the law must lead but it adheres to the view of those who get to speak, which are the people who have the established base of wealth. The true innovator who moves to creation is never that, so the future is tainted by those who have, they either own those who try to push forward and they then adjust the push for maximum wealth, or they buy out those who they do not owe and again they get to control the product.

The game of Patent Law is harsh, difficult and rewarding, because Patent Law was to be a fair field and in that it still is, the world around the law has changed. I am still trying to get the materials and pass this subject, but I also wonder, what can the law do to keep the field fair? In my view, the law has addressed some parts, but the issue where innovation is too often replaced with iteration (pharmaceutical patents for example), how to address that part?

Well I am off to lunch and after that redo my parts on infringements, which would go further if I did not get stumped by texts like: “Further, because the edges at either end of the column neatly align with one another a plurality of such columns of the same height can be suitably employed on an even surface to stably support various objects including a coffee table top or barbecue plate without rocking, for example. The column structure can also be used by itself as a tree guard“.

Life might be a game, but patent Law is not the clearest of rule books to define it by.

The choice of a new religion

The Guardian had an interesting article yesterday by none other than Alex Hern. He and I look towards the gaming world in very different ways, it does not make him wrong and it does not make my view right. We have at times different views on things. That is the wonderful world of gaming, it is one of the few fields where the approach to any solution tends to be almost artistic, many views, none the same can still warrant true correctness or success. In ‘Apple wants the Apple TV to be a games console. But can it be trusted?‘ (at http://www.theguardian.com/technology/2015/sep/12/apple-tv-games-console-can-it-be-trusted), which is a very true piece. The subtitle states ‘Apple would like to see its new set-top box become the next Nintendo Wii. But it’s questionable whether the company really understands gaming‘, which is as true as it gets. I have been ‘connected’ to Apple systems in one way or another since 1990. One thing from the very start is that the Apple systems were always ahead in many ways, even in artistic ways, yet true gaming was never supported to the extent it should have been. One of my very first freelance jobs was to take a look at ‘Balance of Power’ (by Mindscape), I ended up checking it on the Mac as well as the Amiga. Another one was Shadowgate by the same makers. Even though these games were always worshipped, but on the Mac they seemed to be on the side, accepted as in existence, but never truly part of the ‘Apple’ environment accepted. It is hard to get it into words. You would have had to be there to understand it.

The quote “The problem is that games are treated as just another type of app by the company – albeit a very profitable type. The games store, for instance, is organised in exactly the same way as the rest of the app store, with prominence given to a few select apps and then three charts of top-selling paid games, most-downloaded free games, and “top grossing games”“, helps here. It is like a bunch of economists see games in the spreadsheet as deep green and those economists really like deep green (as in profit). Yet games is a lot more than numbers (something Ubisoft has an issue with too). To see Apple people look at games and advice their users on is like going to your accountant for sex guidance. That person gets off on spreadsheets and a balance books, for many people not the orgasmic solutions to embrace. Yet there is also a side where I have to disagree on.

Part one is “Similarly, in the newly-released guidelines for Apple TV apps, the company reveals that “the maximum size of an Apple TV app is limited to 200MB”, with no persistent local storage. In other words, apps must be lean, and they must download everything they show from the cloud“, part two is “The top-tier consoles right now ship their games on Blu-ray discs, which store at least 25GB and can rise to 128GB per disc (twice the total storage of the highest-capacity Apple TV“. Now, Alex speaks the truth and he is 100% correct. My issue is that quote 2 implies (he never really states it anything in that way) that size makes the game, that is wrong. Still there is a truth here. 200Mb is nowhere near enough for any decent game. If we look at previous games, like Metroid Prime on the GameCube, that game exceeds the 200Mb. Many games from the PC could get close to the 200Mb, but will in all likelihood exceed that part.

In addition, the statement “In other words, apps must be lean, and they must download everything they show from the cloud“, which now implies that we are all dependent on quality connection. A property that is even debatable in parts of Western Europe, the US, Canada and Australia. For Apple it must be good to know that at least Scandinavia and its 18 million people will see the bulk of Apple TV gaming. The second issue is “Unlike PC games, consoles have always been fairly locked down by the platform manufacturers. In a way, it’s “no sex, no drugs, only rock and roll” attitude is merely replicating the same approach that Nintendo has emphasised for years in its efforts to keep its games consoles family friendly“. Now I am all for family friendly games, yet some people want more than Mario Kart. Some want to play the master Sergeant (HALO). Some want to be in the wasteland (Fallout) or they want to sneak their ways around a city (Thief). Many of these games would never be allowed, with a massive portion of the gamers being 21+, they end up being nothing more than a nuisance to Nintendo and without a massive arsenal of IP that will not happen any day soon.

It is the final quote that is concern as well as the source of howl of deriving laughter “But its success as a games console would be handing yet more control of the medium to a company which fundamentally looks down on games and gaming. And that should concern anyone who likes to play“, wasting this level of resources on a system with no expertise on quality gaming will put a dent in the Apple coffers, in addition, once rejected by gamers, those at the helm will be forced to take a harsh look at their choices and their considerations. It seems that so far in new gaming only Elite Dangerous made it. If the iMac 5K would have one additional hardware update. If they had something in equal or exceeding the Radeon R9 295X2, the system would become something to behold, not just with Elite Dangerous, but in addition with games like No Man’s Sky (if it ever gets here). The iMac would be an option, the Apple TV is clearly not that option, beyond Minecraft there is not a lot that plays on the Apple TV. So do I disagree with Alex?

Actually no! When we consider his quote “Despite my concerns, there is the chance that the Apple TV could be good for gaming“, it connects to my thoughts that good gaming is not about the size (well not completely). Consider that some of the games that were a massive success on the Commodore 64, the Commodore Amiga and the Atari ST can still be the games in the new generation systems like the Apple TV. The games by Sid Meier, games like seven cities of gold, some of the legends like Lemmings, Dune 2 (Command and Conquer), pretty much most of the games Peter Molyneux made (including Dungeon keeper), there are loads of other games. The opposite is also true, now we can get a pirates game Sid Meier could never offer when he did because technology stopped him. In equal measure quality gaming has dwindled as there are no limitations, so that game designers are no longer trying to squeeze the maximum out of a console. Tomb Raider is an example here. When we consider that Apple TV could get a market, whilst the hard core end games on consoles and PC remains, I state ‘Yes’, that is a definite option. Yet Alex does illustrate a side of Apple that the foundation of Apple should be ‘concerned’ with. “If you want to criticise a religion, write a book. If you want to describe sex, write a book or a song, or create a medical App. It can get complicated, but we have decided to not allow certain kinds of content in the App Store”, in all fairness there should be space for that approach, but it will hinder your business. You see, the guidelines at 15.1 state “Apps portraying realistic images of people or animals being killed or maimed, shot, stabbed, tortured or injured will be rejected“, which is nice but that pretty much sums up almost every game ever made, including New Zealand Story, where the little Kiwi loses health when he touches a spike. 15.3 makes any WW2 game a non-starter, unless Apple insists that Nazi Germany was never a real government where my response becomes: ‘good luck with that one!’

So, even though we can accept that guidelines are needed to keep certain groups (read children) free to wander on the app store selecting games. I get that, but as I stated before, it limits the Apple TV to the realm of Nintendo who already has a massive grip on its user base through several means, why would Apple TV wander in that field? It almost reads like Apple wants to add to the foundation of a failed system. The idea that was a write off in 2007, regarding a big fat fail in 2010, suddenly got the title ‘How Apple’s biggest failure could be one of its greatest accomplishments‘ in 2014 (at http://www.dailydot.com/opinion/saving-apple-tv-think-different/) we see: “Apple has a chance here to beat its competitors to the punch, first and foremost, by making sure that you can play every significant type of video file type that Apple TV doesn’t offer now. This will broaden the range of apps the device can support, and ensure they never have an issue like they did with Hulu again. They would also be wise to create a browser for the device, and to let users access its hard drive“, which is true, yet the article reads like a marketing approach to ‘new’ options for Apple TV and now a year later we see the games ploy. Is it truly about that, or is there a fear within Apple that they are being passed by, passed by those who had a clear goal and by growing in any direction they get to hold onto non-write-off a little longer.

I will let you decide on the parts that are a given, but are they truly a given? I must warn my own view that it is tainted and also clouded. There is a view that comes from true gaming and as such Apple TV does not add up to much, yet what is small can grow and as I stated, let true innovation grow through limitations. It gave us true pearls on three generations of consoles, innovations that seem to be missing in NextGen. Yes, there is still innovation, but not to the extent there was in the past. The idea that Apple starts it up again is partially pleasing. Pleasing because that is the one part that have been downplayed by Microsoft, Sony and Nintendo to the larger extent, if you doubt that, then look at how many independent productions made it to consoles in the past. The fact that this year is a lot more about independents is not a given, it is a fab and no guarantee exists that independents will make it through in 2016 and 2017.

That is the part where Apple could grow, you see I personally believe that the next 12 years will be all about the small innovators. As larger players have become vultures, eating the small ones and carrion eaters as they devour their brands in the insane vision that growth comes from interactive innovation, large jumps are ignored. You only need to see the success of Markus the Notch and Minecraft to see that I am right. Will Sean Murray be the next one to show this? David Braben is on the right track to do so too and they are not alone. Even though Everybody’s Gone to the Rapture is not likely to be the success others are becoming, the truth is that this game is innovative. Even though in respect to my Tomb Raider view that 10 hours of game play is not acceptable, it would be equally unacceptable to see a 6 hour story as a good thing (source: YouTube). Yet, it is a story and the challenge as such is too small. You only need to look back at the game Portal (by Rob Swigart) to see something a lot larger, even though not in an open world environment, the result as well as the story was truly unique. That does not make the game a failure or inferior, yet the truth remains that the challenge needs an upgrade. Too small, yet remains a true innovation compared what is out there. In all this my own perception is an issue for discussion too. Where is it a given that a 10 hour game is insufficient? I base it on past play and play that some games give, as such 10 hours of gaming just doesn’t hack it neither does 6 hours. Yet all this started with a new religion, one of gaming. not the worship of a controller, or the divination of a system, but the choice of what we believe is to be an open direction, a choice of innovation, because without innovation gaming seizes to survive and we get iteration of a given, in the artsy world gaming exists in, that part can never be allowed to remain in iteration. This is one of the core reasons why the iteration of Assassins Creed, the iteration of Lara Croft the raider of Tombs and Call of Duty will simmer down, will cease to be the cash cows they once were.

The future is all about true innovation in gaming, in that Apple TV could have a space if it opens the doors to independent developers. When we consider the iPad, it has had a nice collection of games and some are truly innovative, in all that IOS has a place and the Apple TV could bring it to the big screen (and I do mean on your TV). In the final part, I agree with Alex for the most, except for the part “a company which fundamentally looks down on games and gaming“. I am not certain it does. It seems to have an approach not unlike Nintendo. Do we look down on them? The question does remain when we see gaming as a religion. It could be the one religion that should be without a bible, which is fair enough, but what about the 10 commandments? Should we not consider some guidelines? Personally I state no, but then again, I started in a world where gaming was born, where it evolved. In all this gaming can evolve within any limited system (consider the 16KB VIC-20), as such any system can bring the joy of gaming, we only need to consider where we take gaming. Nintendo took a direction, there is nothing stopping from Apple taking it in the same direction. In my mind, it should be now and forever about innovation, because that is what draws us to a new game. Consider how Elemental Kingdoms took the concept of CCG and gave it a digital evolution, that is just one of many options, I hope many that are yet unemployed and it awaits the next visionary to create that path.

Who? That is up to the developer that dares to dream and make it reality.

Confirmation!

It is always nice to see confirmation, as the large players have now made their presentation, I see that the battle lines are drawn in my favour, in favour of PlayStation players. Make sure you get this, I am not stating that Xbox lost, or that they have bad games, in the world of games, the ones I prefer to play, Sony delivered! The Last Guardian coming in 2016 is pure poetry by controller, Horizon is taking post-apocalyptic views to a new level and the small demo gives a clear view that we have new levels of gameplay to adhere to. Agent 47 is coming to PS4 and the console is also giving us new versions of the old, classics like Streetfighter, with new and awesome graphics, but the same play line that Streetfighter fans love. I saw a new part of actual gameplay of No Man’s Sky, the vreator (not a typo) was showing it off and getting the limelight he deserved. He is showing a level of exploring never seen before, the more I look at it, the more that I see on how Elite: Dangerous and No Man’s Sky together are the perfect experiences non shooter addicted gamers will likely see this generation.

It is scary, but it is true. Consider the past. Most of those over 30 grew up seeing Steven Spielberg as the one creator of movies. After that we now get on his level Joss Whedon and JJ Abrams (not dismissing any other directors here). In games we had a few more, but over 20 years, the big names have been Peter Molyneux, Sid Meier and Richard Garriott. Now we get Gareth Bourn (No Man’s Sky) and David Braben (Elite: Dangerous). In the ‘old’ days David was the man of one game (one game I loved). Now we see that same game evolved beyond our imagination blowing me away and that is not all, so as we see more exceptional movie makers, we will also see more exceptional game makers. These Virtual Creators (vreators) are raising the bar by a lot, One on Xbox (me growling a little now) and one on Sony. Personally I truly hope that both consoles get to enjoy both games, because no matter which console you decided on, both games are as I see it, an absolute must!

Sony also showed a few games that were out there. Firewatch and Dreams, dreams is completely off the wall. Different and unique, which means it will completely appeal to the artsy gamer. Firewatch is set in Wyoming, pretty much in the middle of nowhere, you’re all alone. A mystery that involves two missing women, so good luck with that challenge. And this is just the top of the games. More clear appeal than Microsoft offered, more pure gameplay we had not seen before and this is before we get more on Metal Gear Solid 5. So both systems have unique offerings, and offerings on both, you the gamer gets to choose what gaming style appeals to you. For me, Sony delivers what I desire (apart from Elite: Dangerous).

Sony did not ignore the younger players. With Disney’s Infinity 3.0 it will be giving the Star Wars universe with a limited 1 month exclusive for PlayStation players. So, parents who want to imbue the passion for Star Wars to their kids, they will have the materials to do just that. Loads of options and exclusives, which will be opened for all others after 30 days, some will remain exclusive until the holidays. At least it is a temporary thing for none Sony players. Looking back at the presentations, it seems to me that we got twice the value from Sony in the same time that Microsoft was ‘hyping’ some of their exclusives.

The best thing is to go to www.IGN.com and look at the Sony presentation yourself, download the movie, watch online of stream it to your tablet offline. Everything Sony showed is telling me that we are in for an excellent year of gaming. I reckon that most of us will have plenty to play until the end of 2016. The show ended with Drake, a smooth introduction movie with a nice twist at the beginning, which shows us that the beginners that brought a ‘Crash Bandicoot’ is still reeling the wow factors of players today, with games like ‘a thieves end’ whilst ‘the Last of Us’ still has not stopped appealing the players. Yet so far, the one part that was never truly answered was the gossip and ‘leaked’ news regarding the Mass Effect trilogy on Nextgen, which seems to be not happening as far as I can tell from the news released, but I did see the question all over IGN, they all accept that for those new on consoles, Mass Effect is an established game that can grab the imagination of new players, whilst fulfilling the desire of the seasoned gaming veteran. So we must wonder how much can we rely on this information as such, if not, then why can you pre-order the game in some online shops (with a clear TBA mention though)?

The E3 is still going on, but for me, the important parts are done. Tomorrow we will see Square Enix and Nintendo. I still have my Wii in a box somewhere, I never got the WiiU and to be honest, I have no intention of getting it. The Wii started strong, was messed up by Nintendo Marketing, as such, Nintendo lost a market share part. Yet, last year they regained a lot of visibility with Splatoon, a game that amazed and impressed, it was released this month. For now, Nintendo has nothing new to offer and what I have (3DS) works really well, yet an upgraded version of a Gameboy advance game alone will not do it. Nintendo has work to do, whilst Sony keeps on amazing. Square Enix is another matter. Deus Ex is the big ticket for me, yet the remastered Final Fantasy VII should not be ignored. So far the news all over the place are stating almost the same. Sony delivered!

So as Sony ended one part of the presentation of Dreams with the music ‘life is but a dream’, I will say: “Thank you Sony!”

Another online danger

It seems that we the consumers are soon in danger of being left out in the offline cold. You might not realise it, you might not even worry, but your money, your payments online are finite!

You see, not only are the events of last week troubling (not the UK election mind you), the consequence of allowing this to move forward unanswered could be a costly one.

With online presence there is the additional danger of non-online absence.

For this I will emphasize it with one example. The game is from Enix and the title is ‘Order of War: Challenge‘, if you had bought it from Steam, then you have a possible issue, because the game has been wiped of your account. Now, this is not a massive issue of today, this is an issue from the sheer point of view called ‘You paid for it!’ and now it is no more and you can never play it again. An important fact is that this issue played in 2013, so you might wonder what gives!

That is an excellent question. I for one would not care too much for Steam, I never did. Yet the issue of yesterday is now quickly progressing towards issues out today and even more important those who are out tomorrow and after that. This goes far beyond the wiping of a ‘Silent Hill Playable Demo’. Some changes are made because the circumstances changes, which is fair enough. That is not the true issue (even though the Silent Hill fans who missed out would be miffed).

The issue is found in the mobile and console games out now and more important those released after tomorrow.

Let me give you an example.

The mobile/Tables environment has a game called ‘Dungeon Keeper’. Many of those who loved that game when it was originally released on the PC went nuts the moment that game reappeared. Yet, in hindsight this new game was a massive failure on many levels. The game had actually destroyed the image the masterful game maker Peter Molyneux had built. The game is now all about delaying events and forcing people to make very expensive purchases online in the form of Gems. As micro transactions go, this game is the one example why micro transactions should be illegal. A nice view is given at https://www.youtube.com/watch?v=GpdoBwezFVA. Yet compared to the pc edition of the second game (at https://www.youtube.com/watch?v=6DJmS7prcmE), the mobile game is horrendous.

Now we have an additional side, I cannot tell when this happened, but several people (including me) have only had access to the game once in the last two weeks, there have been ongoing server connection issues. In light of the issues that have been mentioned in the past there is now a matter for other cause. You see, if there is an issue with a game, if you had purchased enough gems, the issue at hand is not just that you are forced to a server, the fact that the server is no longer there and the player can no longer play gives weight to the question whether there should be legal consequences for those eager to sell a micro transaction relying game. Can something offered as ‘freemium’ but will only work smoothly when purchases be made, should that game be allowed to be non-functional?  Should the makers not offer an offline side to the game? That is at the foundation of what is wrong. The danger of consumers paying for something that can be removed as soon as the exploiters no longer consider the product to be viable and it stops working for various reasons.

What are those reasons?

Well Dungeon Keeper is a first example. The fact that a server is down is one thing, the fact that the server cannot be reached for two weeks is an entirely other matter. Which leads us to the question, should games that only have online server options be allowed? Beyond that, when gameplay is removed, are those who paid for additional gaming experience be entitled to credit vouchers?

This is the loaded question because basically it is payment for a service, which should be regarded as temporary, however, was that clearly communicated to those buying the service? Now we have ourselves a different video game altogether!

You see, this part will be a growing issue as people are dependent on downloads and could storage of games that are not played on a daily basis. There is the added consideration that these providers never did anything wrong as they might have specified that in the terms of service, yet who reads them? This is not a business agreement, or isn’t it?

Let me move on (for now to another example).

Now we have (or better states we used to have) the PlayStation 3. It has the option of PSN and PlayStation Home. PlayStation Home was discontinued, but what about those people who have spent money for years on the locations there? There had always been an implied assumption that there would be PlayStation Home in PS4. Clearly implied is not correct, too many sources stated most options in silence. Then when the PS4 came it was initially incomplete and in 2014 the verdict was final, no PlayStation Home on the PS4. And recently PlayStation Home was also removed from the PlayStation 3. There was no fault here, there was never any clear agreement that PlayStation Home was to be ported to the PS4, but to lose it on PS3 would never be an acceptable option to those who like it.

I thought it was a cool place, it was partially useless, yet it had the option of being a playful marketing tool. Trailers, unlockable extra’s for games and so on, there were even a few decent games in that environment. Because it had channels so that people could chat, it was something that is out there that would forever be an option. Now it seems that Sony is mostly rejecting the social media, or it is partially doing that. PlayStation home is not the only place, the profiles are a second part, but here we are forced online and in an almost ‘anti-social network’ situation.

This is where the wheels come off the wagon, you see there is another side to all this!

This all links to the previous as there is a real danger that someone at some point will deactivate a service, then what? There is currently an uneven, unequal and a dangerous push to force people online. There is now a second part that has massive consequences for gamers on a global scale. I have made references with the TPP (Trans Pacific Partnership) before, and it seems that several other sources are now on the bandwagon regarding the dangers here, gaming is only one aspect (and not even close to the biggest one, but because of the global setting of gamers a lot easier to spot). It is not just the ‘profile’ issue, that is the least of it all, but it is a driving force around it. More important, the cost of being ‘online’ could soon be another matter altogether.

It would be too simple to state that the TPP is just a bad consequence of a group of utterly incompetent politicians, mostly staying presently at 1600 Pennsylvania Avenue, but that would be not entirely correct either. You see, their inadequacies resulted in a group of industrials to change the premise on Digital Rights Management (DRM) on a massive scale. For the most, I have mixed feelings. I believe that it is perfectly legit for a corporation to protect their product from being illegally copied. Now, the internet providers (ISP’s) are all about bandwidth, so as such, they like people who copy movies, they love it even better when people copy Blu-rays, because 100,000,000 people going for 2-3 blu-rays every night is a massive amount of bandwidth. There is to the smaller extent that a DRM is all about setting up who can legally use something and who cannot, but that seems to be the smallest tip of the iceberg.

An article in the Sydney Morning Herald gives us ‘http://www.smh.com.au/federal-politics/politicalnews/trans-pacific-partnership-will-push-medicine-prices-up-review-finds-20150303-13sxty.html‘. This is not entirely correct, but not wrong either. If we take this quote “The leaked treaty text also reveals new American and Japanese proposals designed to enhance the ability of pharmaceutical manufacturers to extend and widen their patents on drugs and medicines“, it is the word ‘extend’ that is the issue. Because some pharmaceuticals are all about prolonging, we see more and more new patent additions to give any drug a longer exclusivity, which means that generic medication will be less and less of an option. There is in addition the quote “Jeffrey Bleich, accused Australian consumers of habitually stealing copyrighted content and of being some of the worst offenders with amongst the highest piracy rates … in the world“, that statement makes Jeffrey Bleich an idiot to some degree (not the worst he’s ever been called), because his peers in the Netherlands, Denmark and Sweden say exactly the same and he should properly investigate these matters before making those statements.

Now, he was not being too bright (or massively misinformed) and a mere voicer for large corporations, which is to some degree his job I reckon, but he could have been a smudge more thoughtful in that regard. You see, the American side has been utterly stupid for a long time. Because it was always American first, then ‘whomever is left’! We have seen that in Movies, Music and games. Although music not as much. It started in the mid 80’s when Greed took over and American corporations were utterly clueless on global corporate actions from day one. I am not just talking about Games, or movies (even though they are the most visible ones). No the utter consumer disrespect shown by Ashton-Tate, IBM, Lotus Development Corporation, Oracle, Novell and Adobe was beyond belief in those days. You would actually look forward to meeting with Macromedia, WordPerfect and Corel to see that humanity in IT was an option. Now many of them changed tunes over time, the movie and games industry stayed behind for a long time, it is only recently that the US is seeing that the money of their blockbusters are coming from outside the US in some cases in excess of 75%. Now we have ourselves a ballgame! Now we see the shift some are making, but in other ways.

You see, there is a reason why some people have an aversion to buying a game at 40%-70% more. In my early days, I had no options, a game advertised in the American magazines at $19.95 would cost me $69, that’s a not so nice 300%, so America changed the environment from the very beginning. Even today, Australian gamers will pay 40%-70% more for a new game. Now, we will see casual mention on how it is all about shipping. Well guess again. PSN (PS4) was offering games on day one in a shop for $89, On Amazon it was $59 and guess what, the download in Australia was priced at $99.

How do these elements link?

There are two parts. First the quote by Julian Assange “The TPP has developed in secret an unaccountable supranational court for multinationals to sue states. This system is a challenge to parliamentary and judicial sovereignty. Similar tribunals have already been shown to chill the adoption of sane environmental protection, public health and public transport policies“. It is actually not that far a stretch, you only need to consider the legal disagreements between Apple and Samsung to see the dangers here.

After which the following claim is made “The leaked text shows that this agreement is more about corporate power than “free trade”. Investor-state dispute settlement is really a form of corporate sovereignty“. That part can be found here (at https://wikileaks.org/tpp-investment/WikiLeaks-TPP-Investment-Chapter/page-1.html).

Basically, in there you can find the issue “where foreign firms can ‘sue’ states and obtain taxpayer compensation for ‘expected future profits’“, this now reverts back to the earlier mention of games, movies and especially music. A false dimension of revenue has been maintained by corporate ‘baboons’, claiming ‘loss of revenue’. Relying on incomplete information from Napster, Kazaa and a few others players in the peer to peer networking solution. They basically went on the premise, one download means one sale lost. I believe that this was never a reality. People might download and listed, but would never have bought the bulk of it in the first case. That same premise of certain lacks is seen when we see the quote “Attorney-General George Brandis has signalled his intention to introduce more stringent copyright laws to crack down on online piracy“. In that regard the attorney general does not seem to strike too high on the academic scale of logic (on any given day for that matter). I posted an article on September 10th 2014 called ‘Changing topics?‘, in there the issue is better shown, you see it is not just about copyright, because that could have been dealt with quite easily. It was about Malcolm Turnbull’s anti-piracy forum. You see, if copyright was truly the issue, which would have been easy. But in that event the words ‘revenue‘ and ‘bandwidth‘ were very much skated around. Telstra was extremely cautious (and eager) to steer clear of that because in the case of Telstra, monitoring bandwidth, people actually stopping copying movies will cost Telstra billions! Now we see the consequence!

You see, America is figuring out that it cannot deal with its own ISP’s and they definitely cannot deal with the others like Telstra, Tele 2, Com Hem, KPN, TDC and a few others. They are doing it stepwise and the TPP will give them some options. Now back to that term that is laughingly referred to as ‘expected future profits‘.

One source states: “Losses to Video Game Makers Due to Piracy: $8.1 Billion“, based on what numbers? ISP’s state they cannot monitor. Then we get “Pirated Software Impact to Businesses: $63 Billion“. Again on what premise and how?

Well the first one gives us: “Video game piracy of hand-held games leads to the loss of about $8.1 Billion a year, as losses due to pirating of Sony PSP and Nintendo DS games between 2004 and 2009 lead to worldwide losses of nearly $42 Billion“. Here we see an interesting side. These are only two consoles. More important, these consoles have again and again limited legitimate access to games released in US and Japan again and again. So is this truly about piracy, or is the decision as seen here “Monster Hunter 3rd is the best-selling PSP game ever in Japan with 4,780,000 copies sold. Its PS3 HD remaster sold an excellent 500,000 copies as well, yet neither version is scheduled for an international release“. By the way, is the maker not guilty of discrimination? Let me be frank, I will not and have never condoned pirated games. I believe in getting a game and playing the original (I rarely buy games, so when I do, I will go for the VIP options that an original game brings). So, is this about piracy, or about segregation?

That part is harder to prove in the business case. The source “Business Software Alliance, “2011 BSA Global Software Piracy Study,” May 2012” is an issue. I cannot be certain how they got to $63 billion, but with so many illegal versions of Office, that number seems a lot more plausible. It is funny that there, US and China are the biggest transgressors representing a little less than one third of the entire lost stack. The UK is set at 1.9 billion and Australia less than a billion, yet how were these numbers achieved, through ‘rough’ estimation perhaps?

Now we get to the monkey’s banana moment “Losses due to Music Piracy: $12.5 Billion“, which is stated “According to the Recording Industry Association of America (RIAA)“, yes, they wanted the number to be as high as possible, because it made bad productions and louse representatives look a little better. In addition, some of these numbers cannot be decently vouched for in any way, shape or form. It boils down to well over 500 million CD’s, in a numbers game that number on a population of 7 billion seems small, but here is the kicker, that same source had the following, which I found illuminating: “In a survey of over 6,000 people in Finland between the ages of 7 to 84, researchers found that on average each person who downloaded pirated content online had about 2,900 pirated music files and 90 pirated movie files. The researchers who conducted the study believes that downloaders have more music files is due to the ease of downloading pirated music. According to the study, downloading movie files require faster internet speeds, more digital storage space, as well as a higher technological ability to playback movies“.

The term ‘each person’ now becomes really interesting, because 90 movies boils down to 360 Gb, and 2900 songs come to an rough (very rough) estimation of 14.5 Gb. A person downloading that much would be visible on the ISP counter. You see, you buy bandwidth monthly and downloading this much, as well as watching online and perhaps stuff they no longer have, you are looking at $80 a month, however, only 6 years ago, I paid $70 for 25Gb. you see how the picture changes? That is centre here. By the way, if you think that 25 Gb is little, consider that I have only hit that maximum once during my entire contract with my ISP and that was because on a Friday my system decided to update Windows 7, Office 2013 and my Adobe Master collection, which was quite the resource drain that evening.

Your online presence is now a danger in more than one way. In the first more and more ‘providers’ are forcing us to save on the cloud, forcing us using bandwidth. Now, I understand the first download, but many systems are now gearing towards less memory and more reliant on cloud drives. Which was my issue with the Microsoft Xbox One even before that system was launched.  Are those not streamed services? More important, my issue there was that once a service is disconnected, would we just lose it all overnight? Consider your movie and TV series collection. What happens when your old versions of Star Trek, Dexter and Game of Thrones are discontinued?

In addition, if online presence is essential for our services to run, how will that be monitored? I only need to refer to the Sony hack, to give you a first fright that certain owned items could be lost by a mere scripted command. Again, a situation the consumer is not ready and not prepared for. Now, in the case of PlayStation Home, there is some understanding that certain services will be lost, could a local copy have solved it? (I am asking, not telling). There are unresolved issues, mainly because the new technologies move so fast and to be quite honest, some considerations are new, we never had to make them before. We the consumer must accept that some parts are lost to us at some point. Yes, I loved HERO on the Atari 2600, but to expect that game to function 30 years later is not that realistic either. In that regard, we have attached to software (especially games) to the same extent we hold onto a book. They are not the same, which is a simple reality.

But the dangers of online remain, or do they? In that regard, the issues I raise are mostly about time. We see the failing of a game and losing out on what we spend within a year totally unacceptable, yet in that same notion, we should find peace in the notion that nothing lasts, it is all a mere matter of time. Yet, there we see a partial solution, we cannot realistically expect the provider to give ‘eternal’ support, but is a local version (no servers) after a while, or before the service is pulled a possible solution? That I have yet to see and it is not that far-fetched, because in the end, with the amounts of products and the change of IP, that part is slowly but certainly becoming an essential step to consider, especially in light for the business model of any software corporation. Consider you the player with your game of Halo, or Gears of War. I reckon that at some point, you will accept that online mode falls away, but how would you feel is the single player option falls away too, especially if you still have the console or PC to run it on?

A gaming dimension that will fall away at some point, but are we ready to let go of those moments? Now consider that your console/PC can no longer link to the service, even though you have the original disc. In the new DRM, it is entirely possible that no online verification means no playing the game. This is the certainty that we face and the TPP will push us there a lot faster than you realise. Should you doubt any of the last part, then consider the site gog.com. It holds some of the most brilliant games ever created (sold at very low prices), people still revere these games and many of them (especially the original dungeon keeper) will find a place in the heart of gamers. Moreover, several of these would make fine console games when adapted (higher graphics in most cases). I believe that the MSDOS Dungeon Keeper could be a hit 3DS game (like many other games on that site), even today.

Gaming is not about the latest game (decent graphics and sound aside) it is about joy and the games on that site are most pure joy to play.

Now you might all think that this is about games and many of you readers do not care about games, but now consider that same step when you look at your Office 365 account and the fact that you are pushed away from a version that works perfect for you (like the nightmare Office 2007 users faced in the past). There is an abundance of programs that offer a similar scary outlook.

Now translate this to collections you do care about. Your music, your TV shows, perhaps even your digital books. Do not take the word of those stating that it will not happen, because it will, it has happened in the past, it is happening now and it will happen in the future. The DVD and book on your shelf are a touchable item, that part is (if you treat them properly) secure, something online can be lost by merely removing a server or damaging its data. If someone states that this can never happen, then look at Sony, they experienced that event first hand.

As we trusted games

There is an interesting article in the Guardian I had an issue with to some degree. There is nothing wrong with the article itself, Keith Stuart made a good piece and it reads well (at http://www.theguardian.com/technology/2014/nov/13/games-reviews-are-changing-from-product-assessments-to-tourist-guides), so it came out last week and I only saw it just now.

First paragraph: “A decade ago, a games publisher would send out early copies of its latest release to magazines and websites. It would arrive with some sort of embargo restricting the date of any subsequent review coverage. Then, before the game hit the shelves, there would be range of critical responses to read through. That’s how games reviewing worked for 30 years“, well apart from the embargo, which I was never got. That is pretty much how it went. I started my reviewing in 1988. The age of CBM-64,  Atari ST, CBM Amiga and the IBM PC, which had something graphically ‘state of the art’ called ‘EGA’, the enhanced graphic adapter, which added up to the 15” resolution roughly the same of the average low level smart phone today. Games were in CGA and even though the quality of graphics was low, the quality of gaming was exceptionally high (for what we knew in those days). Roberta Williams (Sierra-on-Line), Peter Molyneux (Bullfrog), Richard Garriott (Origin) and Sid Meijer (Microprose) were the titans of gaming; they are the most profound, but not the only ones from those days.

The second part is the first part I disagree with “Now, it’s so much more complicated. Publishers don’t like releasing code early. It’s not just about protecting sales of mediocre titles (though that happens): they worry about piracy; they worry about major spoilers that could put players off purchasing a game that is highly narrative driven“, I personally believe that it is about mediocre titles. The worry of piracy is less an issue, for the reasons that consoles don’t really allow for piracy any more (compared to the days of Atari ST and Amiga), PC Games need more and more internet authentication (like 99.99% of them), and there is a truth in narrative driven games. When a $50 MGS Zero can be played in less than 30 minutes (according to Gamespot), you know that there is an issue. I go for the mediocre side, because in case of Ubisoft, we saw Watchdogs, AC Unity and now Far Cry 4, Far Cry 4 might have gotten themselves a 85% rating (only 70% on Gamespot), yet this is below par (for such a triple-A title), it means that Ubisoft failed to deliver a main title with a 90% plus game review this year, which is a really bad thing. In addition, Destiny didn’t make the high numbers and on the PlayStation 4, the only titles that truly showed the rating was ‘The last of us’ an amazing game originally released on PS3. From my point of view, it is one of the worst release years in a long while. No matter how new Nextgen consoles are, there is a level of competency lacking more and more.

This links directly to the next part of the article “With triple-A releases now costing $30-50m a pop, no wonder the companies responsible want to control the dissemination of their data and messaging. As in movies, everything is geared toward that opening week – millions of dollars of marketing, the acres of shelf space bought at key retailers – everything has to work just right“, if everything has to work just right, it made me wonder why quality assurance was not managed in better ways. If we see the failing that Assassins Creed Unity shows, gaming is overdue for an overhaul, especially considering the cost of such a triple-A game.

It saddens me to say, as a Sony fan, it did hurt me to see that PS4 gamers have not met the high octane game quality I had expected, I was personally more impressed with several titles exclusive on the Xbox One.

The next part is one I do completely agree with “And then the games themselves have changed. Most new titles have intricate and extensive online multiplayer elements – or they require you to be online just to download updates and/or because publishers want to keep an eye on you“, even though in several regards online play is less and less appealing, or just plainly inferior, the updates are more and more an issue. GTA-V, which is regarded as a good game ended up having a day one 1 Gb+ update need. Which is not the worst, but it shows a level of pressure to market deadlines and not quality. Our broadband internet connections seem to have removed the need of quality testing and fixing before release.

Then we get the part that is indeed an issue “The industry is always telling us that games aren’t products anymore, they are services. You get the initial release, but after that, you get updates, downloadable content, new modes, missions and experiences … So what are you reviewing when a game comes out? It’s potential? It’s raw functionality? You are not reviewing the complete experience anymore” Keith is nailing the nail on the head with a massive hammer, we are now getting a service, not software, but if we see the option that a bought game is nothing more than a service or a potential, how can we be treated fairly as a consumer, when we do not know the full article we are buying? It is a dangerous development when we buy not a game, but a concept. We are not there yet, but the danger is slowly creeping towards the installation drive of the computer we use for gaming, and with that approach is a larger and larger danger that the PC/console will get invaded in a hostile way and how can we be protected when not the system, but the game becomes the backdoor into our private lives, because that is a danger that several parties are not yet looking at (as far as I know).

The rest of the article, you should just read on the Guardian site. I do not completely agree, but Keith gives a good view of his reasoning and it is sound and well worth reading. The question becomes where will we go next? There is more and more indication that people (gamers), are less and less interested in the MMO/multiplayer experience and more into a quality solo play game. There is also a feeling from many that Multiplayer is more and more about micro transactions and less about quality fun. Most will accept micro transactions in free multiplayer games like ‘Blacklight’ and ‘War frame’, we can accept micro transactions to get the weapons that really pack a punch, yet with $90 games, people are not interested in additional charges. Even though in the situation of Black Flag, the additional $4 to get the weapons or technology advantage is nice, and the option clearly states that the upgrades can be gotten in the game whilst playing it. It is left to the person to choose. There is nothing bad about it, but when we see AC: Unity, where micro transactions can get up to $100, questions should be asked, even if those parts can be unlocked through playing. Now, I am not judging the $100 micro transactions, but there is a worry why such a purchase is even offered, how much can be leaped through? The worry is not with Ubisoft’s Assassins Creed: Unity, but after the ‘lessons’ many players were taught through Forza 5 how unsettling micro transactions were. Yet, in all honesty (as I am not an Xbox one user), can they be normally unlocked? If so, the issue is not really there, yet the value of high end cars, when we consider that in Forza 5 you get driver payouts of 35,000. However, some cars go into the millions, you need 285 level updates to be able to afford the 1964 Ferrari 250 GTO and that is only one of many cars, which seems to be an unacceptable way to push people towards micro transactions, it left many players with a bad taste in their mouths. If we look at the issues we see, no matter how we feel about a game, there are sides we’d not agree with and there are sides we are truly against. This varies per player, and as such we need to balance view and feelings, because there is no denying that gaming and games are all about emotions. We go for the games that drive our passion. I myself have been a massive RPG fan, yet when I look at the Elder Scrolls Online (ESO) game, I see little interest to continue this path, yet when I look at Mass Effect 3 and Diablo 3, I see and I experienced the best multi-player ever. To illuminate, ME3 has micro transactions, yet the boxes can be gotten by playing multi-player games, each round gets you credits and the higher leveled you played, the more coins you would get, and then you buy a box with random stuff, some good, some amazing and some average. Diablo has no micro transactions; multi-player there is just great and makes the bosses harder, which gives you better loot. There are not the only good games, there are more, and there are many games are nowhere near this good.

In the end it is about good gaming and plenty of games have it, but my issue is as mentioned earlier, overall quality is down, more often not properly tested, whilst as Keith Stuart states it, newer games seem to be about buying the concept, not the finished product. How games get higher in graphical quality, yet not in gaming quality. Is it just about the new systems, or are we faced with a new level of designers, that cannot stand up to the older titans, the actual visionaries. Titles like System Shock (1+2) can, when graphically updated, compete with the RPG games that were released almost 20 years later. If you want to consider First Person Shooters, then in my mind, Metroid Prime 1+2 are top notch achievements that have not been equaled. They were released on a system inferior to the PS3 and Xbox 360, so why are there no games of that calibre? Well, that would not be honest, they have games of that calibre, but they are equals at best, two games, and the first one 12 years old.

This shows the issue I have with the statements some make. ‘A new game each year’, now we must allow for the fact that marketeers will make wild statements at any given place to keep the press at bay and well fed, so we should not overly ‘analyse’ that part. An example can be found when we look at the Tomb raider series, a series that has seen highs and less so. The series also illuminates a flaw in the gaming industry, when we consider the earlier games we see an amount of gaming that is unparalleled, especially when we consider the first two games. No matter the graphic levels, the games were truly large in comparison and some of the levels were amazing in design. The cistern in the first one and the ship in the second one show a level of design the last one cannot even compete with. What took days in the first two games, took a mere 15 hours in the last game. I will agree that the graphics were amazingly unreal in that game, the game looks large but the levels are in the end small. I saw it as opportunities missed on several levels, but not for the quality of graphics. the interesting side is that Tomb Raider shows the gaming industry as it moved from storyline and innovation towards graphics and narration, which is not that big a mystery. Yet in that shift we have lost levels and game time. Which is why the appeal of RPG is vastly growing, the option to play long times, to visit places and go it your own way and speed, not hindered by narration, scripted events and scripting is more and more appealing to the gamers at large.

Even though many are focusing on the next generation of systems, the next level of gaming is not ready. As I see it, 2015 will show a large rise in quality of gaming, but the true gems will not come until 2016. Mass Effect 4 could be such a game, but will we see true innovation, or will we see a sliding line as the Assassins Creed series have shown. This thought also has a drawback. Good gaming is based on vision, a franchise is about evolutions and forward momentum, but visionary is not a given, but for good gaming an essential need. This is where the wheels tend to come off the wagon. God of War 3 brought that, the AC series did not, it brought iteration. Mass Effect might, and so far, the hype of No man’s sky is likely to bring new boundaries in gaming, but the reality is not always a given and as such, we can only wait and keep faith with the developers, which is why their change and their approach to gaming is so essential to us. There are of course issues with other approaches too. Even though the title ‘Whore of the Orient‘ sounds appealingly original, but will it be so? Time will tell! The danger isn’t what will be good and what won’t be. The issue is that we know how rare visionaries in gaming are. The last proven one was Markus Persson (maker of Minecraft) and Microsoft bought his idea for a mere 2 billion (it’s not that much when you say it fast), which is the highest amount paid for a gaming IP EVER! Consider Microsoft paying that much for one title and you know how rare visionaries in this field are, which is exactly why games are not set in one year increments, and why franchises seem to be key for gaming, but there is a new iteration that some forgot. The upcoming release of Elite, a revamp from the original game decades old, shows that good games are rare and will stand the test of time. The initial interest for Elite could be regarded as proof for that.

So is this about trusted games, trusted developers or new endeavours?

I have one thought, but I keep it to myself, it is important that you the reading gamer make up your own mind. I have given my thoughts on that what I experienced and what I value. I ignored some parts as they are not my cup of gaming, which we all have, out there are leagues of GTA lovers; I am not one of them. I do not debate the 90%+ score, gaming is for gamers and there is space for all of us, no matter which part we run to, from Silent Hills to Mario land. there is space for all of us, some will slaughter in the world of Unity, some crush in the lands of Diablo, we have our preferred places, yet the overall issue is not where we play or who we play as, but the quality of what we play is now in question, it has been in question for some time now and it seems to be getting more and more visible as the industry is pushing for revenue on 5 systems. My direct worry is that we end up with a product based on a 60% effort, which is something none of us had signed on for.

The future of gaming

My life, for the most have been about gaming in one way or another. My fascination with computers started when I was just a young man (an annoying brat to be more precise). I saw the magic of computers when I saw my first Star Trek Episode, which was around 1972 or 1973 (Dutch Television). Computers were magic from that point onwards. You, the reader will not believe or imagine this, but in those days, computers were massive, there were actual career sessions on becoming a Computer Operator. I would not get my fingers on a computer until 1981, but it was more than just love at first sight. Whilst everyone around me was looking at it, if it were a dragon that needed to be carefully prodded with a stick, my journey started in earnest. I could go around the systems in mere minutes. Where sergeants were destroying their own work by not remembering the difference between the ‘write in’ and ‘write out’ buttons on their text processor (Oce), I was circumventing the Defence servers by entering specific parts of the entire logistical system giving the ‘MDETnnnn’ commands at the system prompt. Whilst some were sitting at their desk with their ‘bankgirocent’, holding on to ‘keys’ for their keyboard, so that no one could start certain programs. I was going around the entire system with the entire defence logistical system to explore. But it was not all me, often I was sitting in a corner, listening to a Colonel, who was at that point working on a project called ‘VAB3’. I was helping out, his sergeant; a rather pretty woman thought I was after her. If only (she was really good looking). No, the colonel was the first person where I ACTUALLY learned from, the man had insight and was brilliant, It took me a few days, but then I had a clear grasp of the entire Defence payment system, the codes, the settings and the individual programs, the microfiches taught me the rest.

There was no want for money, for wealth. It was simple learning and exploration. We all learn and grasp in our own ways. Do not worry; it is all still linked to gaming!

My weakness is that I never had any commercial inspiration; I never cared too much about money (other than paying my bills). I was always interested in the Puzzle! In my time I have designed my applications, I made them for friends, I made them as assignments, to make a little cash. I once had the option to automate cinemas, but after one afternoon I dropped it. Not because I could not do it, but because it was too easy. I had solved all parts in less than three hours but I did not write it as it had become a mere exercise. It was my only real flaw and to the smallest extent it still is.

I did actually also do other things (like actual work) with mainframes and at times, with those dinky weird contraptions called PC’s. The IBM PC was bulky, and had two boxes the size of the Google OUYA flat side forward, one slot was for the 360Kb floppy the other slot was for the 10 Mb disk drive, which was priced at $2999. Yes, I did say 10 Megabyte! On the disk was a program called Lotus Symphony version 1.1, which I used to create a program to manage the numbers and information of dangerous cargo on container ships (in those days the fines for too much IMCO 5.1, whilst entering Singapore were truly massive). It took me 3 days to work it out and after that they could find the information in minutes, which before that moment took hours and sometimes up to 2 days to check the containers of a carrier at times having a load of almost 1750 containers. So, I did achieve plenty, but it was always the puzzle that pushed me forward.

masterelite1 So, how does this relate to gaming? To get this, you have to consider the days of non-graphics, where a game like Elite was high resolution graphics (in those days).

It was the first game I actually played for some time on the BBC micro B computer (which was not mine), but I was hooked ever since. I moved from Vic-20 (second hand) to a Commodore 64 and from there on, whatever work I did, it was the console at home that satisfied my need for ‘puzzles’ and exploration.

This now comes back to the game we see getting more and more attention. The game is called ‘No man’s sky’ and the person giving it the visibility it deserves (and more) is Danny O’Dwyer (at http://www.gamespot.com/no-mans-sky/). This game takes me back to several games. First, there was Elite, where we travelled the cosmos, trading and shooting wars from Harmless to Elite. The game is at times mindless get through it, simple, but the trades, the encounters, the jumps to a new place and especially in the beginning, docking with a station, had me and many like me glued to the screen. Later on the Commodore Amiga, some German person made something that looked like a Star Trek simulator, where we could fly to planets, get into orbit and (that was it at the time, the game was not complete). After that Origin (the people behind Ultima and Wing Commander) give is a higher graphics version of Elite and they called it Privateer. Later still Peter Molyneux gave us Black and White, a god creation game. I could go into a lot more detail, but I do not want to bore the reader with my gaming life.

There is one reference that is missing. In the 80’s, there was a comic strip in a magazine called ‘Computer and Video Games (CVG)’ about a ‘god-creation simulator’. Here we have the elements of the puzzle. Here we see the elements of No Mans Sky united. The exploration of a planet, from there we can see and visit the planets in the cosmos and grow in wealth, menace and trade as we find larger and better means for travelling. This game has all the elements of gaming I always loved and this game is close to giving us the almost perfect exploration game, where we are mere travellers in all the freedoms we ever wanted. We are not limited by the confines of Tamriel or Sosaria. This game is close to promising a journey where our own imagination is slowly becoming the only remaining limit in gaming.

That would make this game the most enticing form of gaming we are ever likely to meet and see. It is quite literally Minecraft on an epic scale!

We will always want our Scribble Shooter (or its smoother brother Halo), but gaming is more than a race, a fire fight or even a quest. No Man’s Sky is trying to meet the promise some of the older gamers have waited for, for a lifetime. Will we get that experience? I truly hope so!

I have had good days, even great days in many of the games on nearly all of the platforms. Even today, as we see new games trying to fend for the ‘top’ spot of gaming, some gamers are still yearning back to the games that actually delivered a sense of wonder. Whether it was one of the Ultima games, a Metal Gear Solid, the original thief or even a game like System Shock (both one and two) delivering that sense of joy. Some will desire the days of Mass Effect and would want to walk around the Citadel beyond the few levels we saw. No Man’s land is currently implying that it will offer all of that. That makes the days of Danny O’Dwyer one of the sweetest jobs around, because he could be sitting on the hottest gaming potato of an entire generation of gaming.

Time will tell whether NoMansSkyFieldSean Murray ends up being the greatest marketeer or the greatest game developer. I am hoping for the second one. The only critical view I have (for now) is that it is good to know that it is coming, the fact that the game is still more than a year away is less interesting if we get to see too much of the game so far in advance.

About Gamespot!

It happens; we all make mistakes, even I (although I do not think I made one). I have been a member of Gamespot, officially since 2005, unofficially several years longer. I reviewed, I wrote and sometimes I complained. So, last week during the E3, where I followed it all for the second year in a row, I was again confronted with the technical flaws from Gamespot during the E3. Now, is it the fault of Gamespot? That is hard to answer, considering that they get a few million plus watchers to see the E3 shows live as many cannot attend the events in person. (it costs a boatload to get to E3 and stay there for 3-4 days). So we see the shows, the live events and the walk through the event.

These items are nearly always flawed because we get a lag, the buffers time out and then the show stops until we restart it and we miss some of it. Such things happen when too many attend (or even too many watching from the distance and your ISP times out). Several steps going wrong and it is unclear to see if there is even any blame. Oh and every time there was a timeout and you reloaded the screen we got the mandatory UBI-Soft advertisement again and again. I reckon I saw the Black Flag advertisement trailer at least 50 times during E3 2013.

That is one side. The other side is different. At times we the viewer would get the chance to ask questions live on the show. These are golden moments and we all hope that our question gets asked. Can you imagine getting personally answered by Hideo Kojima, Nobuo Uematsu or Yoshitaka Amano? In the past I met and spoke with Sid Meijer, Richard Garriott and Peter Molyneux and a host of other game makers. I can tell you that getting a personal response from a man like Hideo Kojima would be similar to Lara Croft walking up to you and asking you to sit down and share a beer with her. These are epic moments we might get once in a life time (if ever). So when I wanted to ask a question last year in regard to Arkham City the following happened.

The Gamespot comment screen shows a ‘log in’. (I was already logged in), but I go to the login screen, I re-entered my name and password and it takes me to the comment screen and I cannot comment, because I am not logged in. I try it half a dozen times and the moment to ask the question is gone. Man was I angry! However, I get that the servers are busy! I complained and let it go. Sometimes technology is not on our sides and we just have to swallow the bitter pill of defeat. This year the same thing happened when I was trying to comment on events and this time I really lost it (which happens to all of us)!

Even when angry I do try to keep my sense of humour about myself. So when I saw the article “E3 2014: Kojima Responds to Metal Gear Solid 5 Torture Controversy“, my pesky and creative inner demon woke up. It was quite an interesting article (at http://www.gamespot.com/articles/e3-2014-kojima-responds-to-metal-gear-solid-5-torture-controversy/1100-6420442/), and I responded on my Gamespot blog roughly (the response was deleted by Gamespot) as stated below:

Perhaps it is an idea to add an Easter egg and let the gamer torture information from the Gamespot web team“. There was a little more, but that was what it amounted too.

So read this carefully! I added ‘Easter egg‘, so something to unlock in a game, more importantly, the game Metal Gear Solid 5. The Metal Gear Solid being one of the most revered gaming franchises in gaming history. I would reckon that the web team would like to be immortalised in such a revered gaming franchise. As you see, I did keep some sense of humour about it, even though as I saw it, the Gamespot system failed twice (perhaps even more often). What was their response? I have now been banned (perhaps for life from Gamespot). It is interesting how some people react to issues.

The response was unbalanced and extremely unfair. I decided to take an additional look at Gamespot. There was a lot on IGN and most of it related to either biased or incompetent moderation. The quote “I have been temporarily banned for voicing my opinion on another member’s poor review of a game, after he continually sent me hostile PM’s” is only one of several voicing the quality of moderation. I did however find something else that made me wonder about the state of affairs at Gamespot. I found this at http://bbs.stardestroyer.net/viewtopic.php?f=7&t=116270

By now, most have heard that Jeff Gerstmann, Editorial Director at GameSpot, is now the former Editorial Director at GameSpot. The short of it, confirmed through our own sources: Gerstmann was fired for his negative review of Eidos Interactive’s Kane & Lynch. But there’s more to the story in which Gerstmann — one of the site’s leading editors for over a decade — was terminated this week.

The GameSpot staff is currently keeping publicly quiet, but CNET, the parent organization of GameSpot, issued a response today. “For over a decade, Gamespot and the many members of its editorial team have produced thousands of unbiased reviews that have been a valuable resource for the gaming community. At CNET Networks, we stand behind the editorial content that our teams produce on a daily basis,” reads CNET’s statement.

We’re told Eidos had invested a sizable chunk of advertising dollars for Kane & Lynch — check the before and after shots above of GameSpot’s front page for proof — and then allegedly threatened to pull the ads if the “tone” of Gerstmann’s “6.0” review (just under the current Game Rankings average score of 70%) wasn’t changed. Gerstmann did alter the tone of his critique ahead of publication, but it looks as if that wasn’t enough for management. When asked about the situation, Eidos declined comment to 1UP. “Eidos is not able to comment on another company’s policies and procedures,” said a company representative.

But pressure from other advertisers may have contributed to the clash with editorial. Just a few weeks prior, GameSpot came under fire from Sony Computer Entertainment America for scoring Ratchet & Clank Future: Tools of Destruction a 7.5. In his former position, Gerstmann was responsible for overseeing (and defending) all reviews.

1UP did contact Gerstmann, but he declined comment, likely due to signing a non-disclosure agreement upon his termination, common in situations such as these.

What’s interesting is the timing of his termination, though. GameSpot has never been a stranger to review controversy or publisher backlash. Gerstmann himself had a long history of bucking the popular trend with certain review scores over the many years he critiqued games for the site, most recently scoring The Legend of Zelda: Twilight Princess an 8.8 on Wii. With no transparency into the situation, no one knows if this is something that had possibly been brewing for a while now, but sources point to a recent change in GameSpot management as the real catalyst. Stephen Colvin, former President and CEO of Dennis Publishing — the group responsible for publications like Maxim, Blender and Stuff — became CNET’s Executive Vice President at the end of October. One of Colvin’s jobs would be to oversee the growth of CNET websites, including GameSpot. The editorial in Maxim and Stuff, publications who routinely review games months ahead of their completion and where the line between marketing and editorial is a little less clear, is much different than GameSpot’s. That was apparently reflected quickly when Colvin joined CNET. “New management has no idea how to deal with games editorial,” said one source not long after Colvin came on board. Indeed.

The question becomes what is happening at Gamespot. This is not about the web team, or just the quality of moderation, this goes much deeper. Consider the almost massive amount of advertising that is as I see it UBI-Soft only advertising. I am adding two questions here.

  1. Is UBI-Soft the only one advertising? Which would be rather odd as the gaming industry is a lot larger than just UBI-Soft!
  2. Why was Assassins Creed Black flag reviewed so immensely high? It could be a genuine rating!

I personally saw Assassins Creed a firm notch lower, especially as it contained a repeated 4th generation of glitches. The blog post lights on several issues I had noticed on Gamespot, the first being that early reviews and ratings were less and less common. Consider this quote from Gamespot “We have no player reviews for EA Sports UFC yet“, which is fair enough as the game is not out until…… Yesterday! So that is possible, there is however also no review from Gamespot, which is in my book slightly unacceptable. Are they or are they not a gaming site? I know the E3 just ended, but not all writers went to the E3, did they? The same could be said for Sniper Elite 3, out next week. Not all game developers want their games reviewed early, but at this stage when loads of games are only reviewed after they get into the stores make me wonder why Gamespot is not taking a harder look on this. Over time I have seen several reviews that would not appear until after the games were in the store.

I have been a reviewer myself for 13 years, published in several magazines. In one high point of my ‘career’ I wrote 18 pages in one issue (which was a unique event), which might have been overdoing it a little. For the most, I always wrote positive reviews. As I had at the most space to write about 2-3 games, I had to choose the good ones. I had no intention wasting space on a 30% game if I only had 3-4 pages to write about.

I have seen other opinions from people writing that the 100% game does not exist. Yes, they do, but they are rare moments!

I have given (as far as I remember it) two 100% scored games. The first one was Ultima 7: the Black Gate. When it was released in 1992 in the age of floppies, 640 Kb computers and extended memory, this game was so high above what was released in those days, it was intense. The water views, the houses, the characters. This game was ahead of the games pack by a lot. The second one was Neverwinter Nights. It was released in 2002. This game took RPG in a visible, creative and story based level unlike before. The creation set was just the icing of a very impressive cake. I still regard these two games as bright lights showing the way to game developer as possibilities on how high the quality of a game could go. There were others, but they got a 90%+ rating. Games like System Shock that even, if re-released today, would likely become greater hits then what they were when they were initially launched.

Let’s get back to the issue. I cannot tell how true the blog was. I do however question the influence that is implied in the article on reviewers. I think that GTA-5 is a good game (not my choice of game) and 90% is a view of the reviewer, as was the 75% for Ratchet and Clank. Is the review far below our expectation less value than the one reviewed higher? I have always loved the Insomniac games (I have the bulk of them), which makes me wonder what to make of the ‘star destroyer’ piece and more important are the high reviews too high, the low too low and where do we base the comparison on?

The quote “New management has no idea how to deal with games editorial,” is another matter. A game is software, which means we look at the quality, the play value and the content. Is there a reason to debate Infamous Second Son at 80% when we get 15 hours of play time? Yet, Thief was only granted 60% (which was too low in my mind). A reviewer writes in his (or her) own street of passion, and in my street the games like Ultima, Mass Effect would end up with a high score compared to GTA-5 (which was not my cup of tea). However, no matter what my view is, over the timeline of games reviewed there would be a consistent view, and as such, some will value my views, some will value the view of Carolyn Petit. In the end, reviewers, not unlike columnists will have their own distinct styles and choices which they voice. I believe true reviewers will keep a fair view towards games, even towards games they do not like.

If Gamespot as implied by some has become a mere vessel for advertisement and basic information, then what value is there? The quote “I agree with Gamespot, they use to be good but have gotten far worse” is one that I have seen growing for some time now. I wonder why CBS Interactive is letting, what could be a powerful trademark, slip into something that just seems to become below average. I do not think it is just the people. I immensely enjoyed Johnny Chiodini when he was making Feedbackula (still a shame it got scrapped), Jess McDonell, gaming goddess, wearer of the coolest gaming T-shirts and bringer of excellent news in an upbeat way and there is Cameron Robinson with his Reality Check. They all bring video news in interesting ways. Gamespot also has its share of writers, which makes me wonder why CBS is not taking much harder stance on protecting and ensuring the value of the Gamespot Trademark and the issues that are at hand as I see them. Getting back to Cameron Robinson, you should watch his video “Surprising Facts About Video Games You Probably Didn’t Know” and it only gives a lot more question marks in regards to the implied ‘buckling’ of reviewers to the pressure by the software houses. Is it true? I cannot tell as the only name that keeps coming up is Jeff Gerstmann but the numbers that Cameron Robinson brought states that gaming sales is outperforming the US box office numbers, giving additional power to the question why CBS is not stepping up to the plate fast and immediate.

In the end games are product, they have a represented value and they rely on ‘good’ views. The consumer relies on a trusted portal where they can get reliable information from those with a view on that industry, simply because most people only get to spend money on a game once and they want the best game for them. If Gamespot loses the credibility, then others will step up to the plate, because one does not ignore a market that surpasses the 100 billion dollar mark this year, others will come and take the Gamespot share, whether they will or not will mostly rely on the actions of CBS Interactive.

UBI is not going soft!

Another year and another E3 ends for the gaming industry and their devoted disciples, the gamers! Do not think this group to be soft, to be forgiving or to be misguided. They are running beyond 1 billion believers and they all believe in the power of joy from the game. It is a dedicated group. They have existed for over three decades and their numbers still grow.

They are not dressed in clerical outfits worshipping the house of Pong (it’s an Atari thing). They want their games hard, direct and lasting. I truly believed that this group had been deserted by UBI-Soft. I remain true to the feeling that UBI-Soft had gone soft on gaming. There was that Assassins Creed wannabe game regarding pirates (rated much too high), there were a few flops (which any maker will have) and Watchdogs, which was going to be a PS4 launch night game was delayed by a lot. Then we got Watchdogs, which was good, but had been overhyped too much by too many (not all due to UBI-Soft). So, here we have a maker, making a billion plus, losing the game, or so I thought.

I must admit that UBI-Soft is showing true gaming promise, even if some of the cut scenes are massively overdone (but the younger players love them).

There is Far-Cry 4, a game that until recently I would never consider touching. This game must be mentioned for two reasons. I bought the first one on the 360, and I still regard that as the WORST purchase ever! I did not play the second one, yet at some point I did play the third one and it was excellent. The game showed the openness of Midwinter (an old Microprose game), had the interest of many options, choices and sides and left me with a very good aftertaste in my mouth. UBI-Soft turned a fiasco into a winner. As I bash Yves Guillemot around at times, I must be honest enough to admit victory where he (or his minions) makes them.

I think that E3 2014 shows that not only is UBI-Soft back in the game; they are on route of reclaiming the number one development spot (which I considered that they had lost). There is more of course. I loved the Splinter Cell games, but they messed up Blacklist by not setting up the interface for replaying any better (it was the only flaw in my mind).

As for the new games, I was never much for racing, but the Crew has me yearning for the controller to play an ‘open’ racing game! There is a lot we might still wonder, but the presentation shows something that Sony with Drive Club did not deliver from demo day one and now is unlikely to equal. Now THAT is how you set up a game Monseigneur Guillemot!

Getting back to killing people! Whether the streets of Paris are the place to wander in anonymity is matter for another discussion, yet the idea that it will be an open environment game is without a doubt a massive step forward, especially in the light of the size a village like Paris represents. I was not impressed with Black Flag, but bought it regardless (lack of PS4 choices at launch night). It turned out I was right (read the other articles ‘A body blow to gaming‘ on March 6th and ‘Fifth in a trilogy!‘ on December 4th). Yet, the demo I saw in regards to AC Unity has me interested. It could be a massive turn for the better; I will however write fire and brimstone if they revert to the same ruddy glitches I have seen for 4 iterations.

Next, there will be more Tom Clancy in both the new Rainbow Six (not my cup of tea) and ‘the Division’ which seems to be very much my cup of tea.

Yes, as I see it, UBI-Soft is waking up to smell the need of the gamers and they are implying in their presentations that they are meeting the challenge. Time will tell, but I am a lot more positive about the course Yves Guillemot is taking UBI-Soft. I reckon that Next Gen gaming is finally getting a secure spot in the future.

When it comes down to Next Gen, I am not done yet. I have spoken out against Microsoft (or Micro$oft) in past items more than once. The image they left in 2013 drove me powerfully away from Xbox One and straight into the arms of Sony, which I considered to be the true consoles for a long time (PlayStation One, Two, Three and Four). Their approach of an ‘entertainment’ system in 2013 left me without a doubt that even though they seemed clued in with the Xbox 360, the top of Microsoft forgot what gaming was all about and came up with a half-baked device. I still think that the Xbox one is flawed on several levels, but their presentation on upcoming games does show that they are trying to figure it out. Their show was indeed really good (against Sony’s presentation which had slipped slightly) and the funny remark by Peter Molyneux in regards to Fable Legends that ‘it needs more dog‘ (via Twitter).

There is one more issue that I want to raise at present. It is all about the delays. Part of this is because of places like Gamespot, part of this is because of the Marketing divisions of places like UBI-Soft (and many others) and most of it is because of a truckload of gamers. Yes, I agree I want to play all the games today or even tomorrow, but a good game requires waiting at time. A good game will be done when it is done. So when we see a list of games like Batman: Arkham Knight, The Witcher 3: Wild Hunt, The Order: 1886, Quantum Break, Dying Light and The Division that will not make it to the console in 2014, gamers need to stop crying like little bitches! We (me and millions of gamers) want to play a 90% plus game that is legend, not a game that became mediocre like Thief, because someone at marketing pushed for a quicker deadline. The difference between Arkham City (90%) and Viking: Battle for Asgard (50%) is both timing and vision. We cannot do anything about a lack of vision (something the delayed games are not in short supply of) and timing is what we should give them, even though the valid issue remains ‘why show anything at E3-2013’, which is a discussion for another day; let me assure you of that. If we get back to UBI-Soft, then we must admit that Watchdog, with a 500 page hint guide shows that this game is loaded with stuff. It ended up being an 80% game, on release date this would have been a mere 45% rated joke.

We should never be dependent on ratings, that evidence is seen when we look at Gamespot with AC4 Black flag at 90%, which was too high and Thief at 60% was unfairly low (in my opinion). Yet, they are indicators of what we might want to spend money on. Games will always be overhyped by all (including me), it is influenced by what we played (Thief 1+2) and what we expect to see (the Thief demo at E3 2013). So will the next Rise of the Tomb Raider learn from the mistakes (as I see them) that they made with the 2013 release?

Time and patience will tell!

Is gender equality too futuristic?

This is not an article for many. Some will be livid, some will be outraged and many will be angry. Yet, will my view be wrong? This is at the centre of what some call the future of women in high positions.

If I compare it to Law School, then we have our share of women, most of them highly intelligent, many of them no less to Law savants. The last one might be regarded as a cheated achievement, as they usually come from parents with law education or even law practices. They do have a benefit, but to make it in Law, you cannot get by on daddy’s (or mommy’s) tailcoats. You are either truly good, or you won’t pass past your first case. For me in most cases, it almost feels like cheating, as I would be a 1st generation law graduate. I had to do it alone, no daddy to help me (thank god that the alcoholic is dead). So, there is no anger or envy towards these male of female co-students. As we see how these women are now growing the ranks of the senior, partner positions and the silks of the bench, we see how women are not just up and coming, they are growing the waves of the future benches of the courts. This is not a negative issue for me. As the women had grown in the legal profession from the 80’s onwards, they are now becoming the future of the high courts. In that regard I recall my first year mentor. She was not just bright, she was part of a team that wiped the floor (OK, the proper term is victorious) against the Oxford Law team. even though India won, the fact that both groups outdid Oxford should give you a clear view on how good you need to be. If we see the perception of many students, the regarded rankings like Oxford, Harvard and Yale (as we see Ivy League schools), then the University of Technology Sydney (UTS) did a mighty fine job.

How is all this connected?

I am getting to this. It is first important you see the views I have and the way I got to my view.

So what started all this? Well, yesterday the following tweet passed my screen:

I remember her as a politician (when I was living in the Netherlands). I never saw eye to eye with her views, but I do no hold that against her. What is important is that she is extremely intelligent. I reckon that if Albert Einstein would have been around when she turned 21, his words would have been “Whoa girl, you’ve got skills!” Let’s, be certain about the fact that he would refer to her political skills, not her skills in physics. Basically, she is one clever lady is the view of many.

My issue is all about the International Woman’s day as some ‘portray’ their support of it! I am not against it in any way, but let us take a look at the other side of this.

This we see at http://www.canberratimes.com.au/act-news/adfa-skype-scandal-cadets-sentenced-avoid-jail-20131023-2w0hz.html, where we see the quote “The woman told the court last week that she had been bullied and ostracised across the ADF after details of the Skype affair became public. She said she was offered little support, and was referred to as “that Skype slut” by her peers. The victim said the incident destroyed her life and forced her to leave her dream job in the military.

The two men got a 12 month good behaviour order. The interesting part is that the media seemingly buried it after August 19th 2013. Interesting how little exposure these issues get. I found two more items as they were places after the August date, yet this one (at http://www.radioaustralia.net.au/international/2013-11-09/adfa-cadet-daniel-mcdonald-sacked-over-skype-sex-scandal/1217280) seems to add one more item. The quote “Today, Defence released a statement saying McDonald had been told it intended to sack him in mid-September and after giving him an opportunity to respond, his services were terminated as of last night

So how should that be read? He was offered to walk or get booted?

This is not an isolated case for the military on a global scale. The header ‘Conflicting accounts open U.S. Army general’s sex crimes trial‘ (at http://uk.reuters.com/article/2014/03/07/uk-usa-courtmartial-sinclair-idUKBREA260OK20140307) gives a clear view that we are not anywhere near ready for an International Woman’s day. As we see these transgressions go on and on. In addition, as we see the media staying as blasé and diminishing the exposure of such events, then you tell me how fair it all is. When we see a celebrity drink too much, EVERYONE shows it off to the maximum of the gettable coinage possible, which includes the Washington Post, the Guardian, USA Today, the Huffington Post, Reuters and such large ones. When we see the General being accused of these acts, the amount of newspapers that make it to Google page 1-3 is pretty laughable (even though the big ones mentioned earlier are also there). Why the military? Well, it is pretty much the last bastion of testosterone. When women get an accepted place without the psychic and physical assault dangers, then we are truly entering a new area. If you want to disagree with my view here, which would be fine, then compare the hits you get when you compare the allegations between Brigadier General Jeffrey Sinclair (US Army) and PR guru Max Clifford (UK publicist), so even though the UK is only 20% of the US, Mr Clifford gets 500% more hits on Google. As this goes into the millions I decided not to look at all of them, but is there any value to the conclusion that a PR guy is bigger coverage, or that the media does not ‘regard’ the alleged transgressions as such important news. The General did plead guilty to having an extramarital affair with the captain.

So why do I have this issue? As mentioned before I illustrated the evolution of Law staffing. A Dutch research showed only a few days ago, that the incomes are changing. Within the younger population, income between the younger populations of gender has changed. The women are now ending up with a better pay package. This is in my view clear evidence that not only is there more equality; the game is changing in a better respect for all. If both sides of the gender path will get the same chance to get the high coin, then we are entering a competitive field where the victor takes the spoils, no matter what gender the victor is, it ups the game and all will become better competitors because of it.

Yet, if we see the article CNN placed last year (at http://edition.cnn.com/2013/10/15/opinion/chemaly-tech-leaves-out-women/) we see a clearer view on why I think that there should be an International Woman’s day, but at present there is no reason to party on that event. I must state that I do not completely agree with Soraya Chemaly on her article ‘In tech world, women ignored‘. The reason for this is because as I got my training and degree in IT, the amount of women I saw was a massive minority. When I got into the data game in the 90’s, the women represented a presence of a mere 5% would have been overstating their presence. If getting to the top takes 12-15 years, then it will be at least another decade until we see a visible level of female presence in the tech world. There is however another side to this. When we consider tech PR companies like ‘Panache PR‘, we would see that the founder Cathy Campos is regarded as a global authority in the gaming industry. I met her in the days of Robert Maxwell, as she was the visible side of the marketing of Mirrorsoft (1989) and her drive to market the visibility of games by the visionary Peter Molyneux were ground breaking. She is not just accepted by all, I reckon the newbies in this field will consider an internship with someone like Cathy as the start of a possible golden future.

One of the statements I do not agree with is “The tech industry has a well-documented pipeline problem, one largely the result of gender stereotypes that reach into the educational system” Really? When I was into gaming, meeting any woman who was into games was regarded as a joke, both genders thought of games and gaming as uncool, nerdy and not worth the effort. That view only seriously started to change around the time the Xbox 360 was announced to become the hot potato of the future. So, basically, in that tech field women are less than one console generation old. When we look back to the early years we see the names like Roberta Williams (Kings Quest and a few others), Jane Jensen who worked with Roberta Williams on KQ6. Dona Bailey, who is an Atari Legend as she was one of the founders of Centipede, which is still regarded as one of the better arcade games of all times. Lastly there is Graner Ray who worked on Ultima VII (my favourite RPG series). She entered this field late in the Ultima series, but giving it artistically a unique view. So, when we consider these 4 women to be at the foundations of gaming, is it a wonder that the female population in this tech field is still small? Nowadays, we see a much stronger female representation in the gaming field, and many of them are outstanding in their own rights.

This is why I do not completely agree (not opposing either) the view we see at http://www.polygon.com/2014/3/7/5408194/how-smarter-schools-can-help-break-the-game-development-boys-club. I personally have never cared about who wrote the game, only that it was a good game. Consider that Kings Quest was one of the first PC games I loved. It was made by a woman and that never mattered.

So is it about the game or the developer? This is why I opposed the quote from Soraya Chemaly “Controlling women’s access makes men keepers of speech, keeps sexist status quo“. No! The gamer wants a good game, value for money, so anyone can get into this field with a good product. I reckon that especially in places like India, women could grow into this field as they offer originality in gaming through iTunes (iPad) or Google play (android). I reckon that 6 successful new female developers are all it takes to prove my hypotheses in this case. As additional female developers enter the field from MIT game lab and UTS (and other universities of course) we will see a clear shift. I do have a few questions to my own train of thought, which was caused by the quote I read (at http://www.polygon.com/2014/3/7/5408194/how-smarter-schools-can-help-break-the-game-development-boys-club) “Indie developer Mike Bithell tells us the lack of women in development ‘monumentally embarrassing’ for the games industry“. It raises my concerns on how wrong I might be, but is that because of the games developed, or by the games that get funding? You see, I focused on the gaming side, because that side I know from various sides. As I see women in Law proceed to the high places, I feel that my views remain correct. The ones who now will get the high posts are the ones I study with at University and they are truly good at what they do. That view is to some extend reaffirmed by the NY times (at http://www.nytimes.com/2013/11/12/opinion/great-expectations-for-female-lawyers.html). The quote “Of course, the attrition rate is high for men, too — but not nearly as high; in American law firms, the overwhelming majority of partners are men” shows that even though the men are in a massive majority, these are the partners that came from law school 12 years earlier. It took a while for new generations to get into these seats and as such the women we study with are likely to be the majority of high law ranks as they continue their law careers over the next 10-15 years.

When we get back to gaming we could see a correlation with the evolution of high placed women in gaming. If we accept the quote in the previous link affirms my position “Women make up only 11 percent of the total of those pursuing a career in the games industry as of 2005“. So, women do not select this track, which means that it will take some take until the top of gaming has an equal female representation. Yet, is there unfairness in this? When we see a current coverage of only 11%? So as time progresses we see 1 in 20 making it to the top, not because there is inequality, but because only 5%, which is half of the coverage proves to be that good and the math is on my side as I see it. That same math which predicts that over the next 10 years the women in high law positions will likely double, that same curve will apply to the gaming industry as women pursue in several fields they will take the lead as times passes. The issue that many ignore is that this evolution has been just a little over 2 generations and as we see the gender changes in fields, the growth of women in the area of visionary and evolutionary powers, moved to equality to encompass middle managers, which now leads to upper management, this is not a bad record.

As for International Woman’s Day, I am not against it, or against the visibility. The issue is that the field remains unequal, especially when the media is handing us a ‘stacked’ deck. How eager they are to steer away from certain trials, whilst in most of these cases they just spout the same ‘average leveled‘ information. The stacked deck is not in the direction that the BBC shows (at http://www.bbc.com/news/uk-18187449). As I stated my view, that over time the percentages have shifted and they are shifting even more, but consider the issues as we saw it in regards to Jimmy Saville, not just what he did, but as alleged how those around him are stated to have reacted and how the matter was dealt with for several decades, that part seems to be ignored to a larger extent. Even now as we see the events unfold, we see the Saville jokes, we see the investigation, but the ‘support system‘ around Saville, as he got away with the amount of events does not get the media scrutiny it is supposed to be getting. So, this is not just about the women in general, but the ‘old boy’ groups as they remained around for too long a time. This is the case that many articles made, but I personally see this as the ‘wrong side’. I would much rather see how we see that now in Law, and how women in new fields, like Technology, Gaming and other new areas can more easily inhabit these areas and they could be ruled by the best in the field, no matter what gender. That is the side that does not get enough visibility. It should and the media should use moments like International Woman’s Day to show what is possible, because if it is about inspiration, it should be about where opportunity lies, not just where some ‘stated’ view on the places where the uphill battle remains. This does not mean that I am now opposing my own words, but that it takes time to get women in these top positions, which they achieved within 2 generations (banking examples: CEO Westpac and Christine Lagarde, IMF). When we look at a new field like gaming, which is only now entering its second generation, women are on an equal field, as there is little to no historical entry to content with.

In the end a true visionary will always be successful and get funding, simply because being the first implies that this person is the best and new fields are always ruled by the visionary (closely followed by the evolutionary visionary). Consider this last point; would it have made any difference to the success of Facebook whether it was Mark or Marcia Zuckerberg who invented it?
I feel certain that this would not have made any difference to the global change it brought.
